Լևոն Տեր-Պետրոսյանն ընդդեմ Հայաստանի գործով Մարդու իրավունքների եվրոպական դատարանի` 2012 թվականի մայիսի 15-ին կայացրած որոշմամբ` Դատարանը եզրակացրել է, որ մի շարք հարցերի վերաբերյալ գործում առկա ապացույցները բավարար չեն որոշելու Լ. Տեր-Պետրոսյանի գանգատի ընդունելիության հարցը։ Դատարանը նաև որոշել էր դիմել Հայաստանի կառավարությանը` լրացուցիչ գրավոր դիտարկումներ ստանալու նպատակով։ Դատարանի հիմնական նպատակն էր` պարզել, թե արդյոք 2008 թվականի մարտի 1-ի դեպքերի ընթացքում խախտվել են Լ. Տեր-Պետրոսյանի ազատության իրավունքը, ազատ տեղաշարժման իրավունքը, ինչպես նաև հավաքների ազատության իրավունքը։

2019 թվականի ապրիլի 25-ի Դատարանը կայացրեց վճիռ, որով արձանագրեց, որ գործում առկա չեն ուժեղ և միանշանակ ապացույցներ առ այն, որ խախտվել է Լ. Տեր-Պետրոսյանի ազատության իրավունքը` Կոնցենցիայի 5(1)-րդ հոդվածի շրջանակում, կամ որևէ կերպ սահմանափակվել է վերջինիս ազատ տեղաշարժման իրավունքը` թիվ 4 արձանագրության 2-րդ հոդված շրջանակում։

Ավելին, Դատարանը նշել էր որ, առկա չեն ապացույցներ, որոնք կարող են հիմնավորել, որ անվտանգության ծառայությունները գործել են չարակամորեն կամ չարաշահել են իրենց իրավասությունները։ Դատարանը նաև արձանագրել է, որ այդ բողոքը երբևէ չի քննվել ներպետական մարմինների կողմից, և ըստ էության` Դատարանը չի ընդունել դիմողի կողմից ներկայացված փաստարկները։

Այսպիսով` Լ. Տեր-Պետրոսյանը կարող էր ազատ տեղաշարժվել Երևան քաղաքում` առանց որևէ իրավական և ֆիզիկական սահմանափակումների, ինչպես նաև կարող էր ջանքեր գործադրել կանխելու Մարտի 1-ի ողբերգական դեպքերը։

Կարևոր է նաև արձանագրել, որ 2012 թվականի որոշումով` Դատարանը մերժել է Լ. Տեր-Պետրոսյանի կողմից ներկայացված մի շարք այլ պնդումներ` ակնհայտորեն անհիմն լինելու հիմքով։ Դրանք վերաբերում էին`

  • անձնական կյանքը հարգելու իրավունքին;
  • ազատ արտահայտվելու իրավունքին;
  • արտակարգ իրավիճակներում պարտավորություններից շղմանը; և
  • ազատ ընտրությունների իրավունքին։

2019 թվականի ապրիլի 25-ի վճիռը նաև սահմանել է, որ խախտվել է Լ. Տեր-Պետրոսյանի` Կոնվեցիայի 11-րդ հոդվածով ամրագրված հավաքների ազատության իրավունքը։ Հղում կատարելով Մուշեղ Սաղաթելյանն ընդդեմ Հայաստանի գործին` Դատարանը արձանագրել է, որ ուժի կիրառումը եղել է ոչ համաչափ։

Հատկանշական է, որ, Դատարանը մերժել է Լ. Տեր-Պետրոսյանի այն պնդումը, որ իր «տնային կալանքը» եղել է խտրական` ակնհայտորեն անհիմն լինելու հիմքով։

Վերջում պետք է ընդգծել, որ 2019 թվականի ապրիլի 25-ի վճիռը դառնում է եզրափակիչ, եթե` կողմերը հայտարարում են, որ հրաժարվում են գործը Մեծ պալատին հանձնելուց կամ վճռի կայացումից հետո երեք ամսվա ընթացքում գործի հանձնում Մեծ պալատին չի պահանջվում։
