ՏԻՄ-երի մասին օրենքը բավականին ռիսկային է
VIDEOՎերջին շրջանում շատ է խոսվում ՏԻՄ համակարգի առանձնահատկությունների և այդ ոլորտում սպասվող բարեփոխումների մասին։ Օրերս կառավարությունը գործադիրի կողմից ընդունեց և պատրաստվում է խորհրդարանում քննարկել ՏԻՄ մասին նոր օրենսդրական փոփոխությունները։
Ըստ այդմ՝ նոր նախագիծով մարզպետները համայնքների վրա նախատեսում են ունենալ ավելի լայն ու սեփական խնդիրների, լիազորությունների իրականացման ընդլայնված հսկողության իրականացում։ Օրենքն ուշադիր ուսումնասիրելուց ակնհայտ է դառնում, որ մարզպետների կողմից փաստացի իրականացվող ֆինանսական հսկողությունն իրավասությունների գերազանցում է եղել։
Միաժամանակ պետք է նկատել, որ տվյալ օրենսդրական նախաձեռնությունը կառավարության օրակարգ է մտել առանց լուրջ հանրային քննարկումների՝ փաստացի հաշվի չեն առնվել ոլորտային ներկայացուցիչների կարծիքներն ու դիրքորոշումները։ Երկրում տարածքային կառավարման ապագան ու տեսլականը նշանակալից հարցեր են հանրության համար, ուստի անհրաժեշտ էին մասնակցային լայն քննարկումներ, ինչն, ըստ էության, չի արվել։
Ուսումնասիրելով փաստաթուղթը միանգամից աչքի է զարնում այն փաստը, որ ընդհանուր օրենսդրական մշակման համար հաշվի է առնվել միայն 2-3 գերատեսչությունների առաջարկներ և ըստ այդմ արվել են իրավական դիտարկումներ։
Նոր ժամանակներում «գզրոցային» կամ կուլիսային աշխատաոճը անընդունելի են։, քանի որ այլ են հանրային սպասումները և նման դեսպոտական մոտեցումները միանշանակ այլ ռեժիմների են հանգեցնում։ Կարող ենք ընդգծել, որ առանց խորհրդակցական ինստիտուցիոնալ մեխանիզմների որակական փոփոխությունների հասնելը դժվար կլինի։
Դե իսկ այն փաստը, որ նոր իշխանությունների կողմից նշանակված մարզպետներն ամենանհաջող և չստացված օղակն են հանդիսանում, առաջին անգամ չէ, որ բարձրաձայնվում է, նրանք այն կեպարներն են, ովքեր իրենց անձնական ամբիցիաերը վեր են դասում քաղաքական և պետական շահերից ու առաջ տանում անհիմն և իրավական որևէ հիմնավորում չունեցող դատողություններ։ Այնպես, որ, եթե կառավարությունն ի դեմս վարչապետի, ցանկանում է ունենալ հաջողված և ինքնուրույն, առողջ ՏԻՄ համակարգ, պետք է իր «դրածո» կադրերին սթափության կոչ անի և հորդորի վերնայել իրենց գործողությունները, ոչ թե կուրորեն հաստատոի նրանց առաջ քաշած թեզերը։
Ստացվում է այնպես, որ վերջին մեկ տարվա ընթացքում նրանք գործել են Սահամանդրությանը հակառակ։ Միաժամանակ անհրաժեշտ է նկատել, որ նախագիծը գրված է բավականին լղոզված ու անհասկանալի՝ հնարավոր ակնհայտ ռիսկերն ու բուն ասելիքը ծածկելու համար։
