Սահմանադրական դատարանը որոշում է կայացրել հօգուտ Ռոբերտ Քոչարյանի
SOCIETYԱյսօր ՀՀ Սահմանադրական դատարանը քննության առնելով ՀՀ երկրորդ նախագահ՝ Ռոբերտ Քոչարյանի դիմումը ՀՀ քրեական դատավարության օրենսգրքի 419-րդ հոդվածի 2-րդ մասի վերաբերյալ, որոշեց, որ ՀՀ վճռաբեկ դատարանը գործն ըստ էության չլուծող դատական ակտերի վերաբերյալ կայացնում է վերջնական դատական ակտ և հենց այդ մեկնաբանությամբ նորմը համապատասխանատում է ՀՀ Սահմանադրության պահանջներին:

Սահմանադրական դատարանի այս դիրքորոշումը նշանակում է, որ գործն ըստ էության չլուծող դատական ակտերի, այդ թվում՝ կալանքը որպես խափանման միջոց ընտրելու մասին որոշումների բողոքարկման դեպքում Վճռաբեկ դատարանը չի կարող գործը ուղարկել նոր քննության, այլ ինքը պետք է կայացնի վերջնական որոշում։
Սահմանադրական դատարանը նաև նշել է, որ հաշվի առնելով այն հանգամանքը, որ օրենքը Ռոբերտ Քոչարյանի նկատմամբ Վճռաբեկ դատարանի կողմից կիրառվել է այլ՝ Սահամանադրական դատարանի մեկնաբանությունից տարբերվող մեկնաբանությամբ, Ռոբերտ Քոչարյանի նկատմամբ կայացված դատական ակտը նոր հանգամանքի ի հայտ գալու հիմքով ենթակա է վերանայման՝ օրենքով սահմանված կարգով:
