SOCIETY«Խստորեն դատապարտում եմ այսօրվա գործելաոճը։ Մենք գիտենք, որ ՀՀ Սահմանադրության համաձայն իշխանությունն իրականացվում է իշխանության երեք թևերի միջոցով, և դրանք ոչ թե միմյանց նկատմամաբ ճնշումների միջոցով պետք է իրականացնեն իրենց գործունեությունը, այլ փոխհավասարակշռման հիման վրա։ Բայց այսօր ականատես եղանք մի սարսափելի իրադրության, երբ օրենսդիր և գործադիր իշխանության որոշ ներկայացուցիչներ խոչընդոտեցին դատական իշխանության գործունեությունը՝ խախտելով իշխանության երեք թևերի հավասարակշռությունը»,-այս մասին ասաց փաստաբան Արմինե Ֆանյանը՝ խոսելով վարչապետ Նիկոլ Փաշինյանի հայտարարությանը հետևած ակցիային, երբ առավոտյան 08։30-ից փակվել էին բոլոր դատարանների մուտքերն ու ելքերը։
Նա նշեց՝ տեսնում է լուրջ միջամտություն դատական իշխանության գործունեությանը, ինչպես նաև դատարանի ազատության առջև ծառացած լուրջ խնդիրներ․ «Չեմ կարող ասել՝ որոնք են դրդապատճառները, բայց ըստ երևույթին, դրանք պայմանավորված են հնչեղություն վայելող դատական գործերի որոշումներով, որոնք այնքան էլ հաճելի չէին իշխանական որոշ թևերին։ Համենայն դեպս՝ Ռոբերտ Քոչարյանի վճռին հաջորդեց վարչապետի հակասահմանադրական կոչը։ Բայց գուցե կան այլ դրդապատճառներ, և այս իրադարձությունը հասունացրեց այդ որոշումը»,- նշեց նա։
Նրա խոսքով՝ մենք այսօր մոտավորապես 10 տարով հետքայլ արեցինք և այն հենասյուները, որ կառուցել էինք մեր պետության ստեղծման ճանապարհին, այսօր լուրջ վնաս կրեց։
Անդրադառնալով Փաշինյանի հայտարարությանը, թե դատական համակարգը վիրահատական միջամտության կարիք ունի, փաստաբանը նկատեց․ «Դատավորների վրա ճնշում են գործադրելու, ասեն՝ դիմումներ գրեն և լիազորությունները դադարեցնե՞ն։ Սա ոչ այլ ինչ է, քան ճնշում դատական իշխանության նկատմամբ։ Նրանք, ովքեր հավատարիմ չեն իրենց կոչմանը, արդարադատություն չեն իրականացնում, որովհետև սովոր են զանգովի արդարադատության: Այդպիսիք իրենք չէին դիմանա ճնշմանը։ Դրան պետք է հասնել հասարակական բարձր իրավագիտակցությամբ, ոչ թե պաշտոնյաներին հրահանգել, որպեսզի գնան փակեն դատական իշխանության դռները, ինչը հանգեցրել է մի շարք քաղաքացիների իրավունքների խախտման, ազատության, արդար դատաքննության, ողջամիտ ժամկետներում գործերի քննության»,- ասաց Ֆանյանը՝ հարց բարձրացնելով՝ դրա պատասխանն ո՞վ է տալու։
Փաստաբանի համար դատապարտելի է Երևանի ընդհանուր իրավասության դատարանի նախագահ Ռուբեն Վարդազարյանի պատրաստակամությունը՝ ազատման դիմում գրելու․ «Ստացվում է՝ ինքը պատրաստ չէ աշխատել թափանցիկ դաշտում։ Դատավորը, որն ինքն իր տեղում է և օրենքով ու Սահմանադրությամբ է գործում, ինչպե՞ս կարող է որևէ պաշտոնյայի կոչով ասել, որ պատրաստ է լիազորությունները դադարեցնել։ Ուրեմն՝ ի՞նչ է ստացվում, ինքը ի՞նչ էր կոչված անելու»,- ասաց Ֆանյանը։
Նա նշեց՝ դատավորներ ունենք, որոնք կանգնած են մեր իրավական պետության կերտման ճանապարհի ակունքներում և չի ցանկանա, որ դատական համակարգը կորցնի նրանց։
