ՀՀ վերաքննիչ քրեական դատարանի դատավոր Մխիթար Պապոյանը հանցագործության մասին հաղորդում է տվել: Երեկ՝ 2019 թվականի մայիսի 20-ին, «Facebook.com» սոցիալական ցանցի օգտատեր Արտակ Գալստյանն իր էջում հետևյալ վերտառությամբ հրապարակում է տեղադրել. «Ո՞ՎՔԵՐ ԵՆ ԳՐԵԼ ՌՈԲԵՐՏ ՔՈՉԱՐՅԱՆԻ ԱԶԱՏ ԱՐՁԱԿՄԱՆ ՈՐՈՇՈՒՄԸ»:

Այդ հրապարակմամբ նշվում է, որ «ըստ աղբյուրի» Ռոբերտ Քոչարյանի ազատ արձակելու որոշումը գրել են Վերաքննիչ դատարանի երեք դատավորներ, որոնց թվում եմ նաև ես: Ընդ որում՝ նշված հրապարակումը տարածվել է նաև զանգվածային լրատվության միջոցներով: Նկատի ունենալով, որ նշված հրապարակումն ամբողջությամբ սուտ է, բացարձակապես չի համապատասխանում իրականությանը և պարունակում է հանցագործության մասին տեղեկություններ, հետևաբար՝ համապատասխան մարմիններին խնդրում եմ իմ այս հրապարակումն ընդունել որպես հանցագործության մասին հաղորդում և օրենքով սահմանված կարգով պատշաճ իրավական գնահատական տալ Արտակ Գալստյանի և այդ կեղծ տեղեկությունը վերջինին հաղորդած անձի արարքներին: Հատկանշական է, որ Արտակ Գալստյանը, չհանդիսանալով լրագրող, պարտավոր է բացահայտել տեղեկատվության աղբյուրը:

Ապշեցնող է, որ հասարակության լայն շերտերը և հատկապես զանգվածային լրատվության միջոցները, տեղյակ լինելով Արտակ Գալստյանի և նրա գործելաոճի մասին, դրսևորելով ծայրաստիճան ոչ պրոֆեսիոնալիզմ, նշված սուտ հրապարակումն ակտիվ տարածում են մամուլում՝ ապատեղեկացնելով հասարակությանը: Այս պայմաններում դեռ ուզում ենք խոսել դատավորի բարձր կերպարի, դատավորի անկախության, դատարանի նկատմամբ վստահության ամրապնդման և իրավական պետության մասին:
