Ջիվան Աբրահամյանի կողմից Բակո Սահակյանի հասցեին հնչեցված սպառնալիքների փաստով քրգործի հարուցումը մերժվել է
SOCIETYԱրցախի նախագահ Բակո Սահակյանի հասցեին Նիկոլ Փաշինյանի աջակիցների հանրահավաքի կազմակերպիչներից Ջիվան Աբրահամյանի կողմից հնչեցված սպառնալիքների փաստով քրեական գործի հարուցումը մերժվել է ՀՀ քրեական դատավարության 35-րդ հոդվածի 1-ին մասի 2-րդ կետի հիմքով: Այս մասին Tert.am-ի հետ զրույցում հայտնեցին ՀՀ ոստիկանության հասարակայնության հետ կապի և լրատվության վարչությունից:
ՀՀ քրեական դատավարության 35-րդ հոդվածի 1-ին մասի 2-րդ կետը սահմանում է՝ քրեական գործ չի կարող հարուցվել և քրեական հետապնդում չի կարող իրականացվել, իսկ հարուցված քրեական գործի վարույթը ենթակա է կարճման, եթե արարքի մեջ հանցակազմ չկա:
Հիշեցնենք, որ մայիսի 25-ին ի աջակցություն Նիկոլ Փաշինյանի աջակիցների հանրահավաքի կազմակերպիչներից Ջիվան Աբրահամյանը Ազատության հրապարակում Արցախի նախագահի հասցեին սպառնալիք պարունակող հայտարարություններ էր հնչեցրել։
«Էսօր, որ Բակոենք եկել են ստեղ Ռոբերտ Քոչարյանի համար երաշխիք են տվել, կարո՞ղ ա վաղն էլ տանեք Ղարաբաղ, ասեն՝ չենք տալիս, առանձին Հանրապետություն ա, կարո՞ղ ա տենց բան անեք: Էդ ժամանակ հաստատ իմացեք, հենց Ղարաբաղի ներսում ձեզ կսատկացնեն Ղարաբաղի մեր հայրենակիցները, հանկարծ չփորձեք, սա ձեզ նախազգուշացում ա, չոր կոպիտ պատասխան եք ստանալու… ես առաջինը կլինեմ, որ կոչ կանեմ, գնանք ու գլուխներդ քարով ցխենք»,- ակցիայի ժամանակ նշել էր Ջիվան Աբրահամյանը:
Ջիվան Աբրահամյանը հաջորդ օրը բերման էր ենթարկվել Ոստիկանության Կենտրոնի բաժին Ազատության հրապարակում սպառնալիքներ հնչեցնելու կասկածանքով, այնուհետև ազատ էր արձակվել: Ոստիկանությունը հայտարարել էր, որ Ազատության հրապարակում տեղի ունեցած հավաքի ժամանակ մասնակիցների կողմից հնչեցվել են սպառնալիքներ պարունակող արտահայտություններ։ Կատարված արարքում հանցագործության հատկանիշներ պարզելու ուղղությամբ ոստիկանությունն իրականացնում էր ստուգում քրեադատավարական գործողություններով։
Ջիվան Աբրահամյանի հայտարարությանը արձագանքել էին նաև Արցախի Հանրապետությունից։ Արցախի հերոս, գեներալ-լեյտենանտ Արշավիր Ղարամյանը կոչ էր արել քրեական գործ հարուցել:
