Դատական համակարգի կապիտուլյացիայի առաջին նշանները
POLITICSՌոբերտ Քոչարյանի գործով ցանկացած դատական ակտ, որը կլինի այս ճնշման տակ կայացված, ի սկզբանե ոչ լեգիտիմ է. օրերս լրագրողների հետ հանդիպման ժամանակ ասել է Ռոբերտ Քոչարյանի փաստաբան Հայկ Ալումյանը: Նա հիշեցրել է, որ երբ առաջին ատյանի դատարանի դատավոր Դավիթ Գրիգորյանը որոշեց անձնական միջնորդությունները հաշվի առնելով՝ Քոչարյանի խափանման միջոցը կալանքը չընտրել, ՀՀ վարչապետը, այնուհետև ԱԺ իշխող ուժի պատգամավորները ուղղակի կոչ արեցին ճնշում գործադրել դատական համակարգի վրա, ուղղակիորեն մասնակցեցին ճնումների իրագործմանը, մարդկանց կոչ արեցին փակել դատարանների մուտքերն ու ելքերը, որն իրականացավ: «Սա պարզ մեսիջ էր վերաքննիչ դատարանին, նաև ապագայում պարոն Քոչարյանի հետ առնչություն ունեցող բոլոր դատավորներին, թե ինչ տեղի կունենա, եթե երբևիցե նրանցից որևէ մեկը կհամարձակվի Քոչարյանի վերաբերյալ կայացնել այնպիսի որոշում, որը վարչապետի կամ ԱԺ մեծամասնություն կազմող ուժի սրտով չլինի: Սա ուղղակի եւ ամենաբիրտ ճնշումն էր իշխանական երկու ճյուղերի կողմից իշխանական երրորդ ճյուղի նկատմամբ: Սա աննախադեպ երևույթ էր, որն ուղղակի դարձրեց ոչ լեգիտիմ ցանկացած կայացվելիք դատական ակտ, որը կլինի պարոն Քոչարյանի դեմ: Այսինքն, ցանկացած դատական ակտ, որը կլինի այս ճնշման տակ կայացված, ի սկզբանե ոչ լեգիտիմ է»,-հայտարարել էր փաստաբանը:
Փորձառու փաստաբանի կանխատեսումներն իրականություն դարձան արդեն նախօրեին. վերաքննիչ քրեական դատարանի նախագահ Վազգեն Ռշտունին բավարարեց Հայաստանի երկրորդ նախագահ Ռոբերտ Քոչարյանի գործով Մարտի 1-ի քննչական խմբի ղեկավարի միջնորդությունը և ինքնաբացարկ հայտնեց: Ռոբերտ Քոչարյանի փաստաբանները վերաքննիչում բողոքարկում են Երևանի ընդհանուր իրավասության դատարանի ապրիլի 12-ի որոշումը։ Դատավոր Գագիկ Պողոսյանը մերժել էր Քոչարյանի նկատմամբ անձեռնմխելիության հիմքով քրեական հետապնդումը դադարեցնելու վերաբերյալ պաշտպանական խմբի ներկայացրած բողոքը։
Արդեն նույնիսկ կարևոր չեն այն ֆորմալ մոտիվները, որոնք դրդել են դատավորին ինքնաբացարկ հայտնել։ Ավելի էական է այն հանգամանքը, որ երկրում ձևավորված տոտալ անհանդուրժողականության ու ճնշման մթնոլորտը բացարձակապես չի նպաստում դատական ռեֆորմին ու ճիշտ հակառակը՝ կաշկանդում է դատավորներին, որոնք նման իրավիճակում պարզապես հրաժարվում են քննել Ռոբերտ Քոչարյանի հետ կապված գործերը։ Մարդկայնորեն նման մոտեցումն ինքնին հասկանալի է. ոչ ոք չի ցանկանում դառնալ հասարակության անհանդուրժող, լ յումպենացված խավերի ու, առավել ևս, գործադիր իշխանության ճնշումների թիրախը և կայացնել ոչ թե օրենքից բխող, այլ այնպիսի վճիռ, որը հաճո կլինի նշյալների քիմքին։ Ու նաև ակնհայտ է, որ նման իրավիճակում Քոչարյանի գործը կքննեն դատավորներ, որոնք իշխանության համար հաճո որոշումներ կկայացնեն՝ փաստորեն ապալեգիտիմացնելով գործընթացը:
Սակայն խնդիրը պետք է դիտարկել ավելի գլոբալ համատեքստում։ Փաստորեն վեթթինգը դառնում է ոչ թե դատական ռեֆորմի խորհրդանիշ, այլ վերահսկելի դատական համակարգ ձևավորելու գործիք։ Սա ոչ մի տեղ չտանող ճանապարհ է, որը Հայաստանում իրական է դարձնում քաղաքական, սահմանադրական ճգնաժամի հեռանկարը։ Սրանք դատական համակարգի կապիտուլ յացիայի առաջին նշաններն են։
