Բարձրագույն դատական խորհուրդը չի լինելու սոսկ մշակվող և շրջանառության մեջ դրվող օրինագծերի առնչությամբ եզրակացություն տվող կառույց. այն հանդես է գալու սեփական օրակարգով: Նման հայտարարություն է տարածել Բարձրագույն դատական խորհուրդը։ Կարևորելով դատական ռեֆորմի իրականացումը՝ ԲԴԽ-ն արձանագրում է. «Մենք ելակետ ենք ընդունում այն, որ դատական իշխանության նկատմամբ կա հանրության անհրաժեշտ վստահության պակաս, ինչը վերջին շրջանում փաստել է նաև միջազգային կանխատեսելի մեթոդաբանությամբ սոցհարցումներ իրականացրած ԵԽ փորձագիտական խումբը, և այս ամենի համատեքստում պատկերացնում ենք՝ հանրության ակնկալիքները Բարձրագույն դատական խորհրդից անհամեմատ մեծ են: Մի կարևոր վերապահում. Բարձրագույն դատական խորհուրդը համոզմունք է հայտնում, որ արմատական բարեփոխումների համատեքստում ոչ մի պայմանով նախապատվությունը չի տրվելու անհարկի ցնցումների, քանզի նաև միջազգային փորձն է վկայում, որ դատական իշխանության բարեփոխումներին միտված հնարավորինս անցնցում զարգացումներն են գրանցում միանշանակ հաջողություն՝ միայն հավասարակշռված, Սահմանադրության և միջազգային հանրաճանաչ նորմերին խիստ համապատասխան գործելու դեպքում»:

Թվում է՝ ԲԴԽ հայտարարությունը համահունչ է դատական ռեֆորմին նվիրված՝ Նիկոլ Փաշինյանի մայիսի 20-ի ելույթին։ Սակայն այս հայտարարությունների ընդհանրությունը միայն երկու փաստի ամրագրումն է՝ որ դատական համակարգը չունի վստահության անհրաժեշտ ռեսուրս, ու անհրաժետ են արմատական բարեփոխումներ։

Սակայն այսքանով էլ ընդհանրություններն ավարտվում են, որովհետև ԲԴԽ հայտարարության մեջբերված հատվածից ակնհայտ է դառնում, որ բարձրագույն դատական մարմինն, ըստ էության, դեմ է վեթթինգի կիրառմանը։ Հենց դրա մասին է «անցնցում զարգացումների» մասին շեշտված ընդգծումը։

Եթե անկեղծ լինենք, ապա առայժմ նույնիսկ իշխանության որևէ ներկայացուցիչ չի պարզաբանել, թե ինչ են հասկանում վեթթինգ ասելով՝ սահմանափակվելով ընդհանրական ձևակերպումներով։ Համենայն դեպս, որոշ իրադարձություններ հուշում են, որ իշխանության պատկերացրած վեթթինգի գործընթացի ավարտին մենք ունենալու ենք գործադիր իշխանության կողմից վերահսկելի դատական համակարգ։ ՍԴ անդամի պաշտոնի համար Վահե Գրիգորյանի թեկնածության առաջմղումը ու համառորեն պտտվող խոսակցությունները, որ ԲԴԽ նախագահի պաշտոնը զբաղեցնելու է իշխանության թիմից կամ առնվազն իշխանության համար լրիվ յուրային մեկը, հենց դրա մասին են։

Այս համատեքստում շատ կարևոր է, որպեսզի ԲԴԽ-ն կայունացնող գործառույթ ստանձնի, որը մի կողմից կերաշխավորի դատական ռեֆորմի իրականացումը, մյուս կողմից դատական համակարգը զերծ կպահի քաղաքական կոնյուկտուրայից։ ԲԴԽ հայտարարությունը միտված է այս հրամայականին, այլ խնդիր է, թե ինչքանով է դատական բարձրագույն մարմինն ի վիճակի իրականացնել այս առաքելությունը։
