ԲԴԽ նախագահի տեղակալ Գևորգ Դանիել յանը դադարեցնում է Բարձրագույն դատական խորհրդի անդամի լիազորությունները. նա այդ մասին հայտնել է «Ֆեյսբուք» սոցիալական ցանցի իր էջի միջոցով։ Ավելորդ է ասել, որ այս հրաժարականը սպասելի էր ու ոչ անակնկալ , ու, ըստ էության, բխում է վարչապետ Նիկոլ Փաշինյանի մայիսի 20-ի ելույթի տրամաբանությունից ու նույն օրվա ակցիայի համատեքստից, երբ գործադիր իշխանության ղեկավարի հորդորով մի քանի հարյուր քաղաքացիներ շրջափակել էին դատարանների մուտքերը։


Այդ իրադարձություններից անմիջապես հետո հրաժարական էր տվել ԲԴԽ նախագահ Գագիկ Հարությունյանը, ու գրեթե կանխատեսելի է, որ առաջիկա շաբաթներին կամ ամիսներին ԲԴԽ կազմն ամբողջովին փոխվելու է կամ էական «ռեստարտի» է ենթարկվելու։ Ընդ որում՝ մեծ հավանականությամբ, դա տեղի է ունենալու մինչև խորհրդարանի կողմից օրենսդրական համապա տասխան փաթեթի ընդունումը, այսինքն՝ ականատեսն ենք գործընթացի, որն ուղղակի հետևանք է Փաշինյանի մայիսի 20-ի ելույթի։ Այլ խոսքով՝ վեթթինգը փաստացի մտել է 

գործողության մեջ, ու կարող ենք նույնիսկ արձանագրել, որ հեռանում են դատական համակարգի այն ներկայացուցիչները, որոնց հրաժարականները կամ պաշտոնանկություններն, ըստ էության, կանխորոշված են՝ վեթթինգի ֆորմալ կիրառումից հետո։ Սա, իհարկե, մի կողմից բնական երևույթ է, մյուս կողմից՝ բացարձակապես չի երաշխավորում դատական անկախ իշխանության ստեղծման գործընթացը։

Բանն այն է, որ մինչև համապատասխան օրենսդրական փոփոխությունների իրականացումը, նման «ինքնաբուխ» հրաժարականները կարող են մի կողմից որոշակի քաոս առաջացնել դատական համակարգում, մյուս կողմից՝ ԲԴԽ անդամների երկու թափուր տեղերը փաստորեն համալրվելու են առանց չափանիշների ու հայեցակարգային մոտեցումների, ինչը ծնում է ռիսկեր, որ նախորդ համակարգի հետ փոխկապակցված պաշտոնյաներին կարող են փոխարինել մարդիկ, որոնց հիմնական առավելությունն այն է, որ «յուրային» են նոր իշխանությունների համար։ Համենայն դեպս, ՍԴ դատավորի պաշտոնի համար Վահե Գրիգորյանի, իսկ ԲԴԽ անդամի պաշտոնի համար Գրիգոր Բեքմեզյանի թեկնածության առաջադրումը հուշում է, որ իշխանություններն առաջնորդվում են հենց այս տրամաբանությամբ։ Փորձը ցույց է տալիս, որ այսօրվա խորհրդարանական մեծամասնությունը քաղաքական առումով նույնքան անդեմ է ու դակելու է գործադիր իշխանության բոլոր ցանկությունների, Նիկոլ Փաշինյանի միահեծան իշխանության ամրապնդմանն ուղղված նախաձեռնությունների օգտին։

Սակայն անկախ ամեն ինչից՝ արդեն ակնհայտ է, որ դատական համակարգն, ըստ էության, չի դիմադրելու Նիկոլ Փաշինյանի իմպերատիվ պահանջին, ու սկսվել է, այսպես ասած, կապիտուլ յացիայի գործընթացը։ Այլ խոսքով՝ գործ ունենք ոչ թե դասական վեթթինգի, այլ՝ դրա զուտ հայկական տարբերակի հետ։

Ի դեպ, ուշագրավ է, որ Գևորգ Դանիել յանի հրաժարականից րոպեներ անց պաշտոնը թողեց նաև արդարադատության նախարար Արտակ Զեյնալ յանը։ Ըստ վարկածներից մեկի, Զեյնալ յանի հրաժարականը, ի թիվս այլ պատճառների, պայմանավորված է նաև դատական ռեֆորմի հարցով վարչապետի հետ ունեցած տարաձայնություններով, նույնիսկ խոսվում է Զեյնալ յանի ու ԲԴԽ նախագահ Գագիկ Հարությունյանի ջերմ հարաբերությունների մասին։
