Ինչպե՞ս է որոշվում անչափահաս երեխայի՝ որ ծնողի հետ մնալու հարցը

«Փաստ» օրաթերթը շարունակում է ներկայացնել «Ճանաչեք և պաշտպանեք ձեր իրավունքները» խորագիրը: Շատ են դեպքերը, երբ քաղաքացիները չեն կարողանում պաշտպանել իրենց իրավունքները, քանի որ իրազեկված չեն, իսկ երբեմն էլ որոշ պետական հիմնարկներ էլ ավելի են շփոթեցնում նրանց:

Օրաթերթը, համագործակցելով ՀՀ փաստաբանների պալատի հետ, այսուհետ հանրային իրազեկման արշավ է կազմակերպում, որը կօգնի մեր քաղաքացիներին իմանալ և պաշտպանել իրենց իրավունքները: Նշենք նաև, որ յուրաքանչյուր հինգշաբթի՝ ժամը 10:00-ից մինչև 17:00-ն փաստաբանների պալատի հանրային պաշտպանի գրասենյակն անվճար խորհրդատվություն է տրամադրում ՀՀ բոլոր քաղաքացիներին:

Հարց. – Ինչպե՞ս է կատարվում ամուսնալուծությունը դատարանի միջոցով այն դեպքերում, երբ կողմերից մեկը հրաժարվում է ստորագրել ամուսնալուծության վերաբերյալ որևէ փաստաթուղթ, և ինչպե՞ս է որոշվում անչափահաս երեխայի՝ որ ծնողի հետ մնալու հարցը:

Պատասխանում է փաստաբան Տաթևիկ Բուջատյանը:

-Ինչպես ամուսնությունն, այնպես էլ ամուսնալուծությունն ենթակա են պետական գրանցման քաղաքացիական կացության ակտերի գրանցում իրականացնող մարմիններում: Ամուսնալուծության համար ամուսինները պետք է ՔԿԱԳ մարմնում ներկայացնեն համատեղ դիմում, սակայն լինում են դեպքեր, երբ ամուսիններից մեկը հրաժարվում է համատեղ դիմում ներկայացնելուց կամ առհասարակ հրաժարվում է ստորագրել ամուսնալուծության վերաբերյալ ցանկացած փաստաթուղթ:

Նման դեպքերի համար ՀՀ ընտանեկան օրենսգիրքը սահմանել է, որ ամուսնալուծությունն իրականացվում է դատական կարգով, ընդ որում պետք է նկատի ունենալ, որ ամուսնալուծվելու մասին դատարան ներկայացվող դիմումը ենթակա է վերադարձման, եթե դիմումը ներկայացրել է ամուսինը կնոջ հղիության ժամանակ կամ երեխան ծնվելուց հետո` մեկ տարվա ընթացքում, առանց կնոջ համաձայնության:

Ամուսիններից մեկի դիմումով ամուսնալուծության գործեր քննելիս դատարանը իրավունք ունի միջոցներ ձեռնարկել ամուսիններին հաշտեցնելու համար և իրավունք ունի գործի քննությունը հետաձգել՝ հաշտվելու համար ամուսիններին տրամադրելով մինչև երեքամսյա ժամկետ: Այս դեպքում ամուսնալուծությունը կատարվում է, եթե ամուսինները (նրանցից մեկը) պնդում են ամուսնալուծվելու պահանջը:

Դատական կարգով ամուսնալուծվելիս ամուսինները կարող են դատարան ներկայացնել համաձայնություն այն մասին, թե նրանցից ում հետ են ապրելու երեխաները: Նման համաձայնության բացակայության դեպքում դատարանը պարտավոր է որոշել, թե ամուսնալուծությունից հետո ծնողներից ում հետ պետք է ապրեն երեխաները, ինչպես նաև, որոշել, թե որ ծնողից և ինչ չափով պետք է ալիմենտ (ապրուստավճար) բռնագանձվի:

Նշված հարցի լուծման համար դատարանը գործում ներգրավում է համապատասխան խնամակալության և հոգաբարձության մարմնին, որն ուսումնասիրության արդյունքում տալիս է խորհրդատվական բնույթի եզրակացություն: Դատարանը հարցի քննարկման ժամանակ հաշվի է առնում նաև տասը տարին լրացած երեխայի կարծիքը: Ամեն դեպքում, դատարանը պարտավոր է հարցը լուծել՝ ելնելով երեխայի լավագույն շահերից: Դատական կարգով լուծվող ամուսնության դադարման պահը դատարանի կայացրած վճռի օրինական ուժի մեջ մտնելու պահն է:

Դատարանն ամուսնալուծության մասին դատարանի վճիռն օրինական ուժի մեջ մտնելու պահից երեք օրվա ընթացքում պարտավոր է այդ վճռի քաղվածքն ուղարկել ամուսնության պետական գրանցման վայրի քաղաքացիական կացության ակտերի պետական գրանցում իրականացնող մարմին:
