Oրինակա՞ն է արդյոք դեռահասների ներգրավվածությունը բարեգործական ծրագրերում
SOCIETY«Փաստ» օրաթերթը շարունակում է ներկայացնել «Ճանաչեք և պաշտպանեք ձեր իրավունքները» խորագիրը: Շատ են դեպքերը, երբ քաղաքացիները չեն կարողանում պաշտպանել իրենց իրավունքները, քանի որ իրազեկված չեն, իսկ երբեմն էլ որոշ պետական հիմնարկներ էլ ավելի են շփոթեցնում նրանց:
Օրաթերթը, համագործակցելով ՀՀ փաստաբանների պալատի հետ, այսուհետ հանրային իրազեկման արշավ է կազմակերպում, որը կօգնի մեր քաղաքացիներին իմանալ և պաշտպանել իրենց իրավունքները: Նշենք նաև, որ յուրաքանչյուր հինգշաբթի՝ ժամը 10:00-ից մինչև 17:00-ն փաստաբանների պալատի հանրային պաշտպանի գրասենյակն անվճար խորհրդատվություն է տրամադրում ՀՀ բոլոր քաղաքացիներին:

Հարց - Փողոցում զբոսնելիս ինձ հաճախ են մոտենում դեռահասներ ու երիտասարդներ և, ներկայանալով այս կամ այն բարեգործական հիմնադրամի անունից, գումար են խնդրում: Ուզում եմ իմանալ` արդյո՞ք դա օրինական է:

-Այո, օրինական է, եթե պահպանվել են կարևոր նախապայմաններ:
Նախևառաջ պետք է պարզել` արդյո՞ք այն բարեգործական հիմնադրամը, ում անունից հանդես են գալիս դեռահասներն ու երիտասարդները, իր գործունեությունը ծավալում է օրինական հիմունքների վրա, ապահովված է գործունեության թափանցիկությունը, և կարո՞ղ ենք արդյոք վստահ լինել, որ նման կազմակերպությունները կամ անձինք բարեխիղճ են իրենց նպատակներում:
«Բարեգործության մասին» ՀՀ օրենքի համաձայն՝ մոտեցող դեռահասներն ու երիտասարդները բարեգործության մասնակից կամավորներ են, ովքեր բարեգործության նպատակներից ելնելով՝ կատարում են անհատույց աշխատանքներ բարեգործություն ստացողների օգտին: ՀՀ քաղաքացիական օրենսգրքով և «Հիմնադրամների մասին» ՀՀ օրենքի դրույթներով պետական գրանցման ենթարկված հիմնադրամները ամեն տարի իրենց գույքի օգտագործման հաշվետվություն են ներկայացնում ԶԼՄ-ներով:
Իհարկե, այդ պահին տեխնիկապես դժվար կլինի պարզել բարեգործական հիմնադրամն իրականում գոյություն ունի (բացառությամբ՝ հենց այդ պահին ինտերնետով փնտրելու դեպքերի) և տվյալ բարեգործական ծրագիրն իրականացվո՞ւմ է, թե՞ ոչ, բայց այն քաղաքացիներին, ովքեր պարբերաբար հանգանակություններ են կատարում նման ծրագրերի համար, կարող են նախապես տեղեկանալ բարեգործական հիմնադրամների ցանկին:
Մյուս բոլոր դեպքերում, անձնական վստահության խնդիր է և քաղաքացիներն իրենք են որոշում՝ կատարել կամ չկատարել հանգանակություն:
Հաջորդ կարևոր պայմանն այն է, որ բարեգործությամբ զբաղվող անձինք կամավորական աշխատանքներում 16 տարին չլրացած անչափահաս անձանց ներգրավելուց առաջ պարտավոր են պահանջել ծնողներից մեկի, որդեգրողի կամ հոգաբարձուի, կամ խնամակալի գրավոր համաձայնությունը, որոնք իրենց հերթին կարող են հետաքրքրվել բարեգործների բարեխղճությամբ, անձնական համոզմունք ստեղծել իրենց ծավալած գործունեության վերաբերյալ, և որոշել երեխայի կամավորությանը մասնակցելու նպատակահարմարությունը:
Նշեմ, որ 2017 թվականին ՀՀ կառավարությունը հավանություն է տվել «Կամավորական գործունեության և կամավոր աշխատանքի մասին» Հայաստանի Հանրապետության օրենքի հայեցակարգին, սակայն մինչ օրս չունենք ազգային օրենսդրություն, որը հստակ կարգավորում է կամավորների կարգավիճակը, ուստի կամավորական գործունեության ոլորտը կարգավորվում է ընդհանուր օրենսդրությամբ:
