ՊՆ պայմանագրային զինծառայողին մեղադրանք է առաջադրվել՝ կեղծ վկայական և աշխատավարձի վերաբերյալ կեղծ տեղեկանք օգտագործելու համար. գործը դատարանում է
SOCIETYՀՀ ՔԿ Կոտայքի մարզային քննչական վարչության Նաիրիի քննչական բաժնում ավարտվել է ՊՆ պայմանագրային զինծառայողի՝ ակնհայտ կեղծ վկայական և աշխատավարձի վերաբերյալ կեղծ տեղեկանք օգտագործելու դեպքի առթիվ հարուցված քրեական գործի նախաքննությունը: Մեղադրանք է առաջադրվել 52-ամյա տղամարդուն, տեղեկացնում է ՀՀ քննչական կոմիտեի տեղեկատվության և հասարակայնության հետ կապերի բաժինը:
Մինչդատական վարույթում ձեռք բերված տվյալների համաձայն՝ 1966 թվականին ծնված տղամարդը, վարկով գումար վերցնելու համար, դիմել է մի շարք ֆինանսական կազմակերպությունների, սակայն մշտական աշխատանք չունենալու պատճառով չի կարողացել ՀՀ բանկերում վարկ ձևակերպել:
Իր նպատակն իրագործելու համար 52-ամյա տղամարդը 2018թ. աշնանը Երևանում վճարի դիմաց ձեռք է բերել իրավունք վերապահող, ՀՀ ՊՆ պայմանագրային զինծառայողի՝ ակնհայտ կեղծ վկայական, ինչպես նաև՝ 229 460 ՀՀ դրամ աշխատավարձ ստանալու վերաբերյալ կնքված և դրոշմված, պաշտոնական փաստաթուղթ հանդիսացող կեղծ տեղեկանք:
Իր տրամադրության տակ ունենալով նշված կեղծ փաստաթղթերը՝ նա դիմել է Երևան քաղաքում գործող Ունիվերսալ վարկային կազմակերպություններից մեկին և դրանց հիման վրա՝ կնքել պայմանագիր՝ 300 000 ՀՀ դրամ վարկ տրամադրելու վերաբերյալ:
Գործարքն ավարտելուց հետո 52-ամյա տղամարդն իրեն տրամադրված կեղծ վկայականը վերադարձրել է այն անձին, ումից վերցրել էր:
Ձեռք բերված բավարար ապացույցների հիման վրա՝ 1966թ. ծնված տղամարդուն մեղադրանք է առաջադրվել՝ ՀՀ քրեական օրենսգրքի 325-րդ հոդվածի 1-ին մասով: Նրա նկատմամբ որպես խափանման միջոց ընտրվել է ստորագրություն՝ չհեռանալու մասին:
Հայտարարվել է նախաքննության ավարտի մասին և քրեական գործը, մեղադրական եզրակացությամբ, ուղարկվել է դատարան:
Նախաքննության ընթացքում հայտնաբերված առերևույթ նոր հանցագործությունների հատկանիշներ պարունակող տվյալների հիման վրա՝ ՀՀ քրեական օրենսգրքի 325-րդ հոդվածի 1-ին մասի հատկանիշներով հարուցվել է նոր քրեական գործ, որով նախաքննությունը շարունակվում է:
Ձեռնարկվում են անհրաժեշտ քննչական և դատավարական միջոցառումներ՝ կեղծ վկայականը պատրաստող և իրացնող անձին (անձանց) ինքնությունը պարզելու, նրան հայտնաբերելու և վարույթն իրականացնող մարմնին ներկայացնելու ուղղությամբ:
