Հարգելի՛ հայրենակիցներ,

հաշվի առնելով վերջին օրերին Սահմանադրական դատարանի շուրջ ծավալված իրադարձությունները և քննարկումները՝ հարկ ենք համարում հայտարարել հետևյալը.

  1. Այս օրերին Սահմանադրական դատարանի վերաբերյալ հնչեցված կարծիքների գերակշռող մեծամասնությունը քաղաքական է, ուստի մենք դրանց չենք արձագանքում՝ հաշվի առնելով Սահմանադրական դատարանի դատավորի պարտականությունը հրապարակային ելույթներում և ցանկացած այլ հանգամանքում դրսևորել քաղաքական զսպվածություն և չեզոքություն:
  2. Արված իրավական հարցադրումների առնչությամբ հարկ ենք համարում նշել, որ մասնավոր կարծիքները, Սահմանադրության յուրօրինակ մեկնաբանությունները Սահմանադրական դատարանի համար բնականաբար որևէ իրավական հետևանք առաջացնել չեն կարող:
  3. Սահմանադրական դատարանի բացառիկ լիազորությունն է տալ Սահմանադրական նորմերի վերջնական մեկնաբանություն` ընդ որում, դա կարող է արվել միայն կոնկրետ գործի շրջանակներում:
  4. Հաշվի առնելով, որ արված իրավական հարցադրումները Սահմանադրության և Սահմանադրական դատարանի մասին սահմանադրական օրենքի համաձայն կարող են դառնալ Սահմանադրական դատարանի քննության առարկա, մենք զերծ ենք մնում այդ հարցադրումների վերաբերյալ հրապարակայնորեն կարծիք հայտնելուց:
  5. Սահմանադրական դատարանը աշխատում և աշխատելու է իր բնականոն հունով՝ ենթարկվելով բացառապես Սահմանադրությանը և ապահովելով Սահմանադրության գերակայությունը։
