Պաշտոնավարման ժամկետը լրացել է. ո՛չ նոր ժ/պ կա, ո՛չ էլ մրցույթ է հայտարարված
POLITICSՀայաստանի պետական տնտեսագիտական համալսարանի ռեկտորի ժամանակավոր պաշտոնակատար Ռուբեն Հայրապետյանի վեցամսյա պաշտոնավարման ժամկետը լրացել է 2019 թվականի հունիսի 28ին, սակայն, «Փաստ» թերթի տեղեկություններով, նրա լիազորությունները դադարեցված չեն, և նա շարունակում է գալ աշխատանքի
Ավելին, հայտարարված չէ նաև ռեկտորի պաշտոնի մրցույթը: Նման անորոշության ու անհստակության հետ կապված որոշ պարզաբանումներ ստանալու նպատակով դիմել ենք ՀՀ կրթության, գիտության, մշակույթի և սպորտի նախարարություն: ԿԳՄՍ բարձրագույն և հետբուհական մասնագիտական կրթության վարչության պետ Ռոբերտ Սուքիասյանը «Փաստի» հետ զրույցում նշեց, որ մինչ կառավարությունը կնշանակի ռեկտորի նոր ժ/պ, ներկայիս պաշտոնակատարը ամբողջական իրավասություններ ունի շարունակելու իր գործունեությունը. «Այս մասով որևիցե խանգարող հանգամանք չկա»: Ինչ վերաբերում է մրցույթին, ապա, ըստ Սուքիասյանի, ռեկտորի պաշտոնի համար մրցույթ չի հայտարարվել, քանի որ համալսարանում գործընթաց է սկսվել:
«Մասնավորապես՝ տնտեսագիտական համալսարանը պետական ոչ առևտրային կազմակերպություն է, և հիմա այն վերակազմավորման փուլում է, որպեսզի դառնա հիմնադրամ, ինչպես բարձրագույն ուսումնական հաստատությունների մեծ մասը: Սրանով պայմանավորված՝ ռեկտորի պաշտոնի համար մրցույթ չի հայտարարվել: Նախագիծն արդեն պատրաստ է: Մի քանի շաբաթ առաջ տեղի է ունեցել տնտեսագիտական համալսարանի խորհրդի նիստը, որում առաջարկվել է նոր կանոնադրությունը՝ կազմակերպաիրավական ձևի փոփոխությամբ, և ուղարկվել է մեզ: Մոտ օրերս այն սահմանված կարգով կշրջանառենք: Հետո կձևավորվի հոգաբարձուների նոր խորհուրդ, կհայտարարվի մրցույթ և կկազմակերպվեն մնացած հարցերը: Հիմա ռեկտորի պաշտոնի մրցույթ չհայտարարելը բացառապես սրա հետ է կապված»: Նոր ժ/պ-ի նշանակման մասին էլ վարչության պետն ասաց. «Փաստաթուղթը կուղարկվի կառավարություն: «Հիմնադրամների մասին» օրենքի պահանջով՝ կառավարությունը պետք է նշանակի ժամանակավոր պաշտոնակատար: Կառավարությունը կնշանակի՞ գործող պաշտոնակատարին, թե՞ այլ անձի, հայտնի կլինի առաջիկա 2 ամսվա ընթացքում: Դա օրենքի պահանջ է: Ամեն դեպքում՝ բուհում պետք է լինի լիազորված անձ, որը կազմակերպելու է դրա բնականոն գործունեությունը»:
Սակայն մեզ հետ զրույցում իրավաբանները նշում են, որ լիազոր մարմինը, այսինքն՝ ՀՀ ԿԳՄՍ նախարարությունը, փաստացի թույլ է տվել, մեղմ ասած, անփութություն, քանզի առկա վիճակում ո՛չ ժամանակավոր պաշտոնակատարի պաշտոնավարումը երեք ամսով երկարաձգելու, ո՛չ էլ մեկ տարով ժ/պ նշանակելու նորմերը չեն գործում, քանի որ առաջինը վերաբերում է մրցույթ հայտարարված լինելու և այն չկայանալու պարագային, իսկ երկրորդը՝ նոր ստեղծված կամ վերակազմակերպված (ոչ թե վերակազմակերպվող) միավորներին: Փաստացի, անկախ նրանից, թե ինչ գործընթացներ են տեղի ունենում, լիազոր մարմինը պարտավոր էր մրցույթ հայտարարել: Ուստի, ըստ մասնագետների, արդեն իսկ տեղի է ունեցել օրենքի խախտում:
