«Փաստ» օրաթերթը շարունակում է ներկայացնել «Ճանաչեք և պաշտպանեք ձեր իրավունքները» խորագիրը: Շատ են դեպքերը, երբ քաղաքացիները չեն կարողանում պաշտպանել իրենց իրավունքները, քանի որ իրազեկված չեն, իսկ երբեմն էլ որոշ պետական հիմնարկներ էլ ավելի են շփոթեցնում նրանց:

Օրաթերթը, համագործակցելով ՀՀ փաստաբանների պալատի հետ, այսուհետ հանրային իրազեկման արշավ է կազմակերպում, որը կօգնի մեր քաղաքացիներին իմանալ և պաշտպանել իրենց իրավունքները: Նշենք նաև, որ յուրաքանչյուր հինգշաբթի՝ ժամը 10:00-ից մինչև 17:00-ն փաստաբանների պալատի հանրային պաշտպանի գրասենյակն անվճար խորհրդատվություն է տրամադրում ՀՀ բոլոր քաղաքացիներին:

Հարց - Ո՞վ կարող է լինել ժառանգ:

Պատասխանում է փաստաբան Մարինե Ֆարմանյանը:

ՀՀ քաղաքացիական օրենսդրության համաձայն՝ ժառանգն այն անձն է, որին անցնում է այլ քաղաքացու՝ ժառանգատուի գույքը վերջինիս մահվանից հետո՝ իրավահաջորդության կարգով:

Այլ կերպ ասած՝ ժառանգն այն անձն է, որն օրենքի կամ կտակի ուժով ժառանգում է որևէ մեկից, ստանալով նրա թողած գույքը, այսինքն՝ ժառանգությունը: Ժառանգ կարող է լինել քաղաքացիական իրավունքի ցանկացած սուբյեկտ՝ քաղաքացի, իրավաբանական անձ, Հայաստանի Հանրապետությունը, համայնքները:

Քաղաքացիները և համայնքները կարող են ժառանգ լինել և՛ ըստ օրենքի, և՛ ըստ կտակի: Իսկ իրավաբանական անձինք կարող են ժառանգ լինել միայն կտակի ուժով:

Ժառանգը ժառանգական իրավահարաբերության սուբյեկտներից մեկն է: Քանի դեռ նա չի ընդունել ժառանգությունը, նրան է պատկանում ոչ թե ժառանգատուի գույքի նկատմամբ իրավունքը, այլ միայն ժառանգությունն ընդունելու իրավունքը:

Ժառանգությունն ընդունելուց հետո ժառանգը մտնում է այն նույն իրավահարաբերությունների մեջ, որոնց մասնակիցը նախկինում եղել է ժառանգատուն: Սակայն նա այդ իրավահարաբերությունների մեջ է մտնում միայն ժառանգման մասին օրենսդրությամբ հաստատված սահմաններում:

Մասնավորապես, նա պատասխանատու է դառնում ոչ թե ժառանգատուի բոլոր պարտքերով, այլ միայն իր ստացած գույքի արժեքի սահմաններում:

Ըստ կտակի և ըստ օրենքի` ժառանգներ կարող են լինել ժառանգության բացման օրը կենդանի, ինչպես նաև ժառանգատուի կենդանության օրոք սաղմնավորված և ժառանգությունը բացվելուց հետո կենդանի ծնված քաղաքացիները:

Ըստ կտակի` ժառանգներ կարող են լինել նաև ժառանգության բացման օրը գոյություն ունեցող իրավաբանական անձինք, Հայաստանի Հանրապետությունը և համայնքները, ինչպես նաև օտարերկրյա պետություններն ու միջազգային կազմակերպությունները:

Ինչպես ըստ օրենքի, այնպես էլ ըստ կտակի, ժառանգ կարող են լինել իրական անձինք, ովքեր կենդանի են ժառանգության բացման պահին: Սակայն նույն կանոններով ժառանգ կարող են լինել նաև ժառանգատուի կենդանության օրոք սաղմնավորված և նրա մահից հետո ծնված նրա երեխաները:

Տվյալ դեպքում օրենսդիրը պաշտպանում է ոչ թե սաղմնավորված երեխաների, այլ իրավունքի ապագա սուբյեկտների շահերը, քանի որ եթե ծնունդը տեղի չունենա, ապա կկորչի սաղմնավորվելու ժառանգական-իրավական նշանակությունը և փաստն ինքնին:

Ժառանգատուի կենդանության օրոք նրանից սաղմնավորված երեխաները կարող են ժառանգ լինել և՛ ըստ կտակի, և՛ ըստ օրենքի ժառանգման դեպքերում: Սակայն ժառանգատուի կենդանության օրոք ուրիշներից սաղմնավորված և կենդանի ծնված երեխաները կարող են միայն լինել ըստ կտակի ժառանգներ:

Ընդ որում, երեխան ժառանգ է համարվում, եթե ծնվելուց հետո ապրել է թեկուզև շատ կարճ ժամանակ: Բնականաբար, մահացած ծնվածը ժառանգ չի կարող համարվել:
