«Փաստ» օրաթերթը շարունակում է ներկայացնել «Ճանաչեք և պաշտպանեք ձեր իրավունքները» խորագիրը: Շատ են դեպքերը, երբ քաղաքացիները չեն կարողանում պաշտպանել իրենց իրավունքները, քանի որ իրազեկված չեն, իսկ երբեմն էլ որոշ պետական հիմնարկներ էլ ավելի են շփոթեցնում նրանց:

Օրաթերթը, համագործակցելով ՀՀ փաստաբանների պալատի հետ, այսուհետ հանրային իրազեկման արշավ է կազմակերպում, որը կօգնի մեր քաղաքացիներին իմանալ և պաշտպանել իրենց իրավունքները: Նշենք նաև, որ յուրաքանչյուր հինգշաբթի՝ ժամը 10:00-ից մինչև 17:00-ն փաստաբանների պալատի հանրային պաշտպանի գրասենյակն անվճար խորհրդատվություն է տրամադրում ՀՀ բոլոր քաղաքացիներին:

ՀԱՐՑ - Ի՞նչ է վճարման կարգադրությունը, և ի՞նչ պետք է անել, երբ քաղաքացին ստանում է վճարման կարգադրություն։

Պատասխանում է փաստաբան Տաթևիկ Բուջատյանը:

Վճարման կարգադրությունը պարտատիրոջ (այն անձի, ում հանդեպ ունեք չկատարված դրամական պարտավորություններ) դիմումի հիման վրա դատարանի կողմից արձակվող և պարտապանին (Ձեզ) ուղղված որոշակի դրամական պարտավորություններ կատարելու կարգադրություն է։ Պարտատիրոջ պահանջը համարվում է որոշակի, եթե այն սահմանված է կողմերի համաձայնությամբ կամ կարող է ճշգրիտ որոշվել օրենքի կամ պայմանագրի հիման վրա:

Վճարման կարգադրությունը ստանալիս դուք համարվում եք պատասխանող և պարտավոր եք կատարել հետևյալ գործողություններից մեկը՝

1.Եթե համաձայն եք ներկայացված դրամական պահանջի հետ՝ երկշաբաթյա ժամկետում պարտավոր եք կատարել վճարման կարգադրությունում նշված գումարը պարտատիրոջը վերադարձնելու կամ վճարելու պահանջը,

2. Իսկ եթե ամբողջությամբ կամ մասնակի համաձայն չեք ներկայացված պահանջի հետ, իրավունք ունեք երկշաբաթյա ժամկետում ներկայացնել առարկություն վճարման կարգադրությունը արձակած դատարան՝ հայտնելով Ձեր անհամաձայնության մասին։ Առարկություններ կայացնելու դեպքում վճարման կարգադրությունը դատարանի կողմից վերացվում է:

Այն դեպքում, երբ Ձեր կողմից վճարման կարգադրությունը (տեղեկացումը) ստանալու օրվանից հետո` երկու շաբաթվա ընթացքում, դատարանն առարկություն չի ստանում կամ ստանում է երկշաբաթյա ժամկետի խախտմամբ, ապա վճարման կարգադրությունը ստանում է օրինական ուժի մեջ մտած վճռի ուժ և ենթակա է հարկադիր կատարման:

Դատարանը պարտատիրոջ պահանջով բռնագանձման մասին դիմումի հիման վրա տալիս է կատարողական թերթ, որի հիման վրա էլ հարկադիր կատարողի (Հարկադիր կատարման ծառայության) կողմից հարուցվում է կատարողական վարույթ և վճարման կարգադրությունում նշված գումարի չափով բռնագանձում է տարածվում Ձեզ պատկանող գույքի նկատմամբ:
