«Փաստ» օրաթերթը շարունակում է ներկայացնել «Ճանաչեք և պաշտպանեք ձեր իրավունքները» խորագիրը: Շատ են դեպքերը, երբ քաղաքացիները չեն կարողանում պաշտպանել իրենց իրավունքները, քանի որ իրազեկված չեն, իսկ երբեմն էլ որոշ պետական հիմնարկներ էլ ավելի են շփոթեցնում նրանց

Օրաթերթը, համագործակցելով ՀՀ փաստաբանների պալատի հետ, այսուհետ հանրային իրազեկման արշավ է կազմակերպում, որը կօգնի մեր քաղաքացիներին իմանալ և պաշտպանել իրենց իրավունքները: Նշենք նաև, որ յուրաքանչյուր հինգշաբթի՝ ժամը 10:00-ից մինչև 17:00-ն փաստաբանների պալատի հանրային պաշտպանի գրասենյակն անվճար խորհրդատվություն է տրամադրում ՀՀ բոլոր քաղաքացիներին:

«Փաստի» խմբագրությանը հարցով դիմել է Արթուր Սիմոնյանը (անուն-ազգանունը փոխված է – խմբ.):

-Մի տարի առաջ ինձ ծանոթ մի մարդուց գնել եմ 650 000 դրամ արժողությամբ համակարգիչ: Քանի որ արժեքը շատ մեծ էր, մենք այդ համակարգչի վերաբերյալ ստորագրեցինք առքուվաճառքի պայմանագիր, որտեղ հստակ նշված է, որ վաճառողը հանձնում է իր համակագիչը, իսկ ես՝ վճարում դրա դիմաց: Այժմ, երբ անցել է մեկ տարի, համակարգիչը ինձ վաճառած անձը քրեական պատասխանատվության ենթարկվեց, իսկ քրեական գործով էլ պարզվեց, որ համակարգիչը վաճառողի սեփականությունը չի եղել: Այժմ համակարգչի սեփականատերը ինձանից պահանջում է համակարգիչը: Արդյոք պարտավո՞ր եմ այն վերադարձնել, և նման իրավիճակում ի՞նչ իրավունքներ ունեմ:

-Եթե դուք համակարգիչը հատուցմամբ (գումար վճարելով) ձեռք եք բերել այն վաճառելու իրավունք չունեցող անձից (ձեր ծանոթից), որի մասին դուք տեղյակ չէիք այն գնելու ժամանակ և չէիք էլ կարող իմանալ, ապա դուք համարվում եք համակարգիչը բարեխիղճ ձեռք բերող, և համակարգչի իրական սեփականատերն իրավունք ունի ձեզանից համակարգիչը հետ պահանջել միայն այն դեպքում, երբ իրական սեփականատերը կամ այն անձը, ում տիրապետմանն է հանձնվել համակարգիչը, կորցրել է այն, կամ հափշտակել են նրանցից, կամ էլ նրանց տիրապետումից դուրս է եկել այլ եղանակով՝ անկախ նրանց կամքից:

Այսպես, եթե, օրինակ՝ համակարգիչը վաճառողը հափշտակել էր այն սեփականատիրոջից ու վաճառել Ձեզ, ապա նման իրավիճակում սեփականատերն իրավունք ունի այն հետ պահանջել Ձեզանից:

Նման իրավիճակներում կարևորվում է այն հանգամանքը, թե ինչպես է համակարգիչը դուրս եկել սեփականատիրոջ տիրապետումից:

Ձեր դեպքում անհրաժեշտ է ուշադրություն դարձնել, թե իրական սեփականատերը ինչպիսի՞ պայմաններում է զրկվել համակարգչի նկատմամբ իր տիրապետումից, դուք համակարգիչը գնելու ժամանակ գիտեի՞ք կամ նման իրավիճակում կարո՞ղ էիք իմանալ, որ համակարգիչը վաճառողը չէր դրա սեփականատերը, ինչպե՞ս է հայտնվել համակարգիչը վաճառողի մոտ: Այս հարցերի պատասխանները կարող են նաև բացահայտված լինել քրեական գործի շրջանակներում:

Եթե, օրինակ, համակարգչի սեփականատերը կարողացավ ապացուցել, որ նա համակարգիչը կորցրել է, կամ նրանից այն հափշտակել են, կամ այն դուրս է եկել իր տիրապետումից անկախ իր կամքից, ապա նա միայն այդ դեպքում կարող է այն ձեզանից հետ պահանջել:

Պատճառն այն է, որ գույքի բարեխիղճ ձեռքբերողն օրենքով պաշտպանված չէ սեփականատիրոջ՝ գույքը վերադարձնելու պահանջից, եթե գույքը վերջինիս տիրապետումից դուրս է եկել նրա կամքից անկախ պատճառներով: Սակայն երբ դուք նրան վերադարձնեք համակարգիչը, դուք իրավունք եք ունենում ձեր գումարը վերադարձնելու պահանջով դիմել վաճառողին և ստանալ վճարված գումարն ու հասցված վնասները:
