Ավտոապակիների մգեցման արգելքը սպասարկո՞ւմ է որոշակի բիզնես շահերի

Վերջերս ճանապարհային ոստիկանությունը հաղորդագրություն էր տարածել, որում վարորդներին զգուշացնում է, որ տրանսպորտային միջոցների ապակիների լուսաթափանցելիությունը սահմանված կարգին չհամապատասխանեցնելու դեպքում ճանապարհային ոստիկանությունը կկիրառի օրենքով նախատեսված պատասխանատվության միջոցներ:

Հիշեցնենք, որ ՀՀ կառավարության որոշման համաձայն՝ տրանսպորտային միջոցների հողմապակու լուսաթափանցելիությունը պետք է լինի 75 տոկոսից ոչ պակաս: Իսկ առջևի դռների, առջևի կողային և այլ ապակիներինը` 70 տոկոսից ոչ պակաս: Հետին տեսանելիության 2 հայելիների առկայության դեպքում այլ ապակիների (հետևի դռների ապակիներ և հետևի դիտապակի) լուսաթափանցելիությունը կարող է լինել 70 տոկոսից ցածր: Եթե վարորդները չեն պահպանում այս որոշմամբ սահմանված նորմերը, ապա խախտման համար նրանց սպասվում է տուգանք: Այսպես, վարչական իրավախախտումների վերաբերյալ ՀՀ օրենսգրքի 123-րդ հոդվածի 4-րդ մասի համաձայն՝ ապակիների լուսաթափանցելիության չափի կամ կարգի խախտմամբ՝ վարագուրապատված տրանսպորտային միջոցներ վարելն առաջացնում է տուգանքի նշանակում` սահմանված նվազագույն աշխատավարձի հիսունապատիկի չափով՝ 50 հազար դրամ:

Past.am-ը ՕԵԿ պատգամավոր Հովհաննես Մարգարյանից, ով վերջերս ակտիվ է ավտոճանապարհատրանսպորտային ոլորտի վերաբերյալ օրինագծեր մշակելով, հետաքրքվեց, թե կարող են արդյոք իրականությանը մոտ լինել այն պնդումները, որ մգեցված ապակիներով երթևեկությունն արգելող օրենքը հիշել են միմիայն որոշ բիզնես շահերին սպասարկելու նպատակով: Մեզ հետ զրույցում պատգամավորը կիսեց այն մտահոգությունները, որ ավտոմեքենաների մգեցման բիզնեսն այս պահին կանգ է առել, իսկ օրենքը հիշեցին, որպեսզի հանեն մգեցված թաղանթները, մի որոշ ժամանակ անց օրենքը նորից մոռացության կմատնեն: Այդ ժամանակ մգեցման թաղանթ ներկրողները և մգեցման գործունեությամբ զբաղվողները կրկին կարող են շահույթ ունենալ, երբ որ օրենքի արգելքը պայմանականորեն կվերանա և վարորդները կրկին կսկսեն մգեցնել ապակիները:

«Էս նո՞ր մտքերն ընկավ, տասնյակ տարիներ այդ օրենքը գործել է: Եթե նման բիզնես, շահեր չկան, ապա ինչու վարորդներին չեն տալիս երկար ժամանակ, թող համապատասխան սարքեր բերեն, որ վարորդը կարողանա ստուգել մգեցվածությունը քանի տոկոս է»,- մեկնաբանեց Մարգարյանը` հավելելով, որ այս պահին չկան համապատասխան սարքավորումներ, որոնք կպարզեն մգեցվածության աստիճանը, ինչը հետագայում կբերի անճշտությունների:

Պատգամավորը դժգոհեց նաև տուգանքի չափից, ըստ նրա` 50 հազար դրամ տուգանք սահմանելը սխալ է, բացի այդ մեծ գումարներ են պահանջվում նաև մգեցված թաղանթները հանելու համար, ինչը, պատգամավորը նույնպես անթույլատրելի է համարում: «Եթե կանխարգելիչ միջոցներ են, ժամանակ տվեք մարդկանց, քիչ տուգանքներ նշանակեք, օգնեք, հավասար պայմաններ ստեղծեք բոլորի համար»,- վրդովվեց պատգամավորը` դժգոհելով, թե մարդկանց տալիս են մի քանի օր ժամանակ, վերջիններս էլ ճարահատյալ ընդունում են խաղի այդ կանոնները:
