Ի՞նչ անել, երբ փոխառության գումարը չեն վերադարձնում
SOCIETY«Փաստ» օրաթերթը շարունակում է ներկայացնել «Ճանաչեք և պաշտպանեք ձեր իրավունքները» խորագիրը: Շատ են դեպքերը, երբ քաղաքացիները չեն կարողանում պաշտպանել իրենց իրավունքները, քանի որ իրազեկված չեն, իսկ երբեմն էլ որոշ պետական հիմնարկներ էլ ավելի են շփոթեցնում նրանց:
Օրաթերթը, համագործակցելով ՀՀ փաստաբանների պալատի հետ, այսուհետ հանրային իրազեկման արշավ է կազմակերպում, որը կօգնի մեր քաղաքացիներին իմանալ և պաշտպանել իրենց իրավունքները: Նշենք նաև, որ յուրաքանչյուր հինգշաբթի՝ ժամը 10:00-ից մինչև 17:00-ն փաստաբանների պալատի հանրային պաշտպանի գրասենյակն անվճար խորհրդատվություն է տրամադրում ՀՀ բոլոր քաղաքացիներին:
Հարց-Ի՞նչ կարգով է վերադարձվում փոխառության գումարը և հնարավո՞ր է արդյոք վիճարկել փոխառության պայմանագիրը:

Փոխառուն պարտավոր է, փոխառության պայմանագրով նախատեսված ժամկետում և կարգով, փոխատուին վերադարձնել ստացված փոխառության գումարը: Այն դեպքում, երբ վերադարձնելու ժամկետը պայմանագրով որոշված չէ կամ որոշված է ցպահանջ, փոխառության գումարը փոխառուն պետք է վերադարձնի այդ մասին փոխատուի պահանջը ներկայացնելու օրվանից երեսնօրյա ժամկետում, եթե այլ բան նախատեսված չէ պայմանագրով:
Փոխառության գումարը համարվում է վերադարձված այն փոխատուին հանձնելու կամ նրա բանկային հաշվին փոխանցելու պահին, եթե այլ բան նախատեսված չէ փոխառության պայմանագրով:
Փոխառուի կողմից փոխառության պայմանագիրը խախտելու դեպքում փոխառության գումարին վճարման են ենթակա նաև ՀՀ քաղաքացիական օրենսգրքի 411-րդ հոդվածով նախատեսված տոկոսագումարները՝ սկսած այն օրվանից, երբ գումարը պետք է վերադարձվեր մինչև գումարը փոխատուին վերադարձնելու օրը:
Փոխառուն իրավունք ունի վիճարկել փոխառության պայմանագիրը, եթե ապացուցում է, որ ինքը փոխատուից իրականում դրամ կամ այլ գույք չի ստացել կամ ստացել է պայմանագրում նշվածից ավելի պակաս քանակով:
Վկաների ցուցմունքների միջոցով փոխառության պայմանագրի վիճարկում չի թույլատրվում, բացառությամբ այն դեպքերի, երբ պայմանագիրը կնքվել է խաբեության, բռնության, սպառնալիքի, փոխառուի ներկայացուցչի և փոխատուի չարամիտ համաձայնությամբ կամ այլ ծանր հանգամանքների բերումով:
Եթե փոխառության պայմանագիրը վիճարկելիս պարզվում է, որ փոխառուն դրամը կամ այլ գույքն իրականում չի ստացել փոխատուից, փոխառության պայմանագիրը համարվում է չկնքված: Եթե դրամը կամ այլ գույքը փոխառուն փոխատուից ստացել է պայմանագրում նշվածից ավելի պակաս քանակով, պայմանագիրը կնքված է համարվում ստացված քանակի գումարի կամ գույքի չափով
