Սա խայտառակություն է. Լուսինե Սահակյանը՝ Դավիթ Գրիգորյանի լիազորությունների կասեցման մասին
POLITICSՏասնյակ փաստաբաններ համախմբել և իրենց պատրաստակամություն են հայտնել ստանձնելու դատավոր Դավիթ Գրիգորյանի պաշտպանությունը։
«Խնդիրը միայն Դավիթ Գրիգորյանի պաշտպանությունը չէ։ Եթե մենք թույլ տանք, որ նրա նկատմամբ հետապնդումներ իրականացվեն, ապա սրանով դատական համակարգը վերջնականապես կմահանա, և մենք դատարաններ այլևս չենք ունենալու։ Եթե մենք մի փոքր ցանկություն ունենք ունենալու անկախ դատական համակարգ, մենք պարտավոր ենք կանգնելու Դավիթ Գրիգորյանի կողքին և ստանձնելու նրա պաշտպանությունը»,–ասաց Սահակյանը։
Փաստաբանը խայտառակություն որակեց Դավիթ Գրիգորյանի լիազորությունների կասեցումը։
«Սա խայտառակություն է։ Նույնիսկ նախկին իշխանությունների օրոք նման բան չէինք կարող սպասել, քանի որ ակնհայտ է, որ Դավիթ Գրիգորյանը հետապնդվում է իր կողմից կայացված որոշումների համար և կոնկրետ Ռոբերտ Քոչարյանի գործով կայացրած որոշումների համար»,–ասաց նա։
Լուսինե Սահակյանի խոսքով՝ ներկայումս բացահայտ հետապնդում է իրականացվում այն դատավորների նկատմամբ, որոնք փորձում են արդարադատություն իրականացնել, անկախ լինել և ղեկավարվել միայն օրենքով։
«Մենք չտեսանք, որ հետապնդվեն այն դատավորները, որոնք ակնհայտ ապօրինություններ են իրականացնում, փաստորեն այդ բոլոր դատավորները ձեռնտու էին իշխանություններին, նրանք բնականաբար նրանց կամակատարն էին»,–ասաց նա։
Ըստ փաստաբանի՝ Դավիթ Գրիգորյանի նկատմամբ հետապնդում իրականացնելով փորձ է արվում «վախեցնել մյուս դատավորների աչքը» և նրանց ամբողջովին ենթարկեցնել իրենց։
«Տարիներ շարունակ մենք պայքարում ենք, որ դատարանները կայանան, անկախանան և կարողանան արդարադառոնթւթյուն իրականացնել, սակայն գնալով իրավիճակը շատ ավելի է վատանում»,–ասաց նա։
Լուսինե Սահակյանը հիշեցրեց, որ իշխանությունները սկզբնական շրջանում հայտարարում էին, թե դատական համակարգի նկատմամբ ճնշում չեն գործադրելու, չեն միջամտելու դատական համակարգի գործունեությանը, սկայն հետագայում պարզվեց, որ ճիշտ հակառակն է տեղի ունենում. իշխանություններն ամեն ինչ անում են, որպեսզի դատավորները ենթարկվեն իրենց։
«Փաստորեն նրանց միակ նպատակն ու դժգոհությունը դատական համակարգից, կայանում էր նրանում, որ կան որոշ դատավորներ, որոնք սկսեցին չենթարկվել իրենց»,–նկատեց նա»։
Անդրադառանոլով ԲԴԽ–ի կողմից՝ Դավիթ Գրիգորյանի նկատմամբ քրեական հետապնդում հարուցելուն համաձայնություն տալուն, փաստաբանը նկատեց, որ այդ քայլով ԲԴԽ–ն ցույց տվեց, որ կազմի փոփոխությունը որևէ լավ բանի չհանգեցրեց և որ նոր կազմը իշխանահաճո որոշումներ է կայացնում։
Ըստ փաստաբանի՝ սարսափելին այն է, որ դատավոր Դավիթ Գրիգորյանի նկատմամբ քրեական հետապնդում հարուցելուն համաձայնություն են տվել նաև ԲԴԽ–ի դատավոր անդամները։
«Եթե դատավոր անդամներից քվեարկած չլինեին ի օգուտ այդ որոշման, այդ որոշումը չէր ընդունվի»,–ասաց նա։
Հիշեցնենք, որ հուլիսի 26-ին ՀՀ գլխավոր դատախազի պաշտոնակատարի կողմից Բարձրագույն դատական խորհուրդ է ներկայացվել միջնորդություն՝ երեք դրվագով Հայաստանի Հանրապետության քրեական օրենսգրքի 314 հոդվածի 1-ին մասի (պաշտոնեական կեղծիք) հատկանիշներով քննվող քրեական գործով դատավոր Դավիթ Գրիգորյանի նկատմամբ քրեական հետապնդում հարուցելու համաձայնություն տալու մասին։ Հաջորդ օրը ԲԴԽ–ն որոշում է կայացրել միջնորդությունը երկու դրվագներով բավարարել, իսկ մեկով՝ մերժել։ Այսպիսով օրենքի ուժով դատավոր Դավիթ Գրիգորյանի լիազորությունները կասեցվել են։
