Ես չէ, որ Ձեզ «քուանշել» եմ, այլ Ձեր այժմեական շեֆը՝ Նիկոլ Փաշինյանը
BLOGՀՀԿ-ական նախկին պատգամավոր, ԱԺ նախկին փոխնախագահ Արփինե Հովհաննիսյանն իր ֆեյսբուքյան էջում անդրադարձել է ՀՀ Գլխավոր Դատախազի օգնական Գոռ Աբրահամյանի գրառմանը։
«Դատախազության այսօրվա բալլադի մասին՝
Նախ բովանդակային՝
• Ուրախ եմ, որ Դավիթ Մելքոնյանը պատմել է Ձեզ եվրոպական նախադեպերի մասին, սակայն, շատ ափսոս, որ քվինտէսենցիան կարծես բաց եք թողել։ Եվրոպական դատարանը ձեւական եւ բովանդակային առումով քրեական հետապնդումները հավասարեցնում է այն դեպքում, երբ կա հարուցված քրեական գործ, ու թեեւ մեղադրանք առաջադրված չէ, սակայն դրանում նշված է համապատասխան անձի անունը։ Իսկ դուք որպիսի ունենաք ՁԵՒԱԿԱՆ հիմքը ապօրինի հարուցում եք գործ, որ հետո մեղադրյալը առարկի կամ էլ ոչ: Այլ կերպ ասած դուք հիմա մտածում եք, որ բոլորից ճարպիկ եք եւ հարուցում եք քրեական գործեր, որպեսզի ձեւական առումով ՄԻԵԴ պրակտիկան կիրառելի դարձնեք, սակայն այս դեպքում, նույնիսկ ձեւական առումով չպետք է լիներ քրեական հետապնդում, որովհետեւ չի կարելի բռնի կերպով արդարադատություն իրականացնել այնտեղ, ուր ընդհանարապես չպետք է գործ հարուցվի։ Ի դեպ Եվրոպական դատարանի այս մոտեցման շրջանակներում է հենց ձեր մատնանշած գործը, որը վերաբերում է քրեական հետապնդումը դադարեցնելուն, քրեական գործի վարույթը կարճելուն, բայց ոչ ամենեւին քրեական գործ չհարուցելուն։
• Վճռաբեկ դատարանի որոշումներն էլ մեջբերելիս լավ կլինի ընտրողական մոտեցում չցուցաբերեք, այլ որպես մանիպուլիացիաների դեմ պայքարի իսկական առաջամարտիկ ներկայացնեք ողջ պատկերը։ Այսպես, լավ կլիներ մեջբերեիք նաեւ Վճռաբեկ դատարանի Ա. Սաղաթելայնի վերաբերյալ ԳԴ5/0022/01/10 գործով դիրքորոշումն առ այն, որ Վճռաբեկ դատարանն արձանագրում է, որ ինչպես թիվ 62216908 քրեական գործը հարուցելու, այնպես էլ Ա.Սաղաթելյանին մեղադրանք առաջադրելու պահին քրեական պատասխանատվության ենթարկելու վաղեմության ժամկետներն անցած են եղել, հետեւաբար մինչդատական վարույթն իրականացնող մարմնի` քրեական գործ հարուցելու, իսկ այնուհետեւ նաեւ քրեական հետապնդում սկսելու մասին որոշումները եղել են ոչ իրավաչափ եւ կայացվել են ՀՀ քրեական դատավարության օրենսգրքի 35-րդ հոդվածի 1-ին մասի 6-րդ կետի պահանջների խախտմամբ։
Իսկ հիմա մնացածը՝
Պարո՛ն գլխավոր դատախազ, քանի որ իրավահարաբերության սուբյեկտ ես ու դուք ենք ուստի աշխատակցիդ տրակտատներ գրելու հանձնարարական տալուց առաջ լավ կլիներ բացատրեիք, որ ես չէ, որ Ձեզ «քուանշել» եմ, այլ ձեր Ձեր այժմեական շեֆը՝ Նիկոլ Փաշինյանը։ Վստահ եմ նաեւ վերջին շեֆը։
Հետեւաբար, եթե այդքան դուխով էիք, ստորեւ ներկայացված ելույթում ( հղումը՝մեկնաբանությունում) ահագին բան կար «սրելու», սակայն, կարծես թե, ամեն ինչ այն ժամանակ համբերատար կուլ տվեցիք։ Բացատրեիք նաեւ, որ իմ քաղաքական օպոնենտի բառապաշարը ձեր համատեղ շեֆի բառապաշարն է, հետեւաբար այդ բառապաշարին պետք է սարսուռով վերաբերվել։ Ու բլոտի հրավերն էլ ուղղել իրեն։ Թե կարող եք:
Պարո՛ն Դատախազ,Գուցե ձեզ թվում է , որ ինձ հետ հեռակա բանավեճը Ձեր մոտ լավ է ստացվում, քան Ազգային ժողովում 2017 թվականին Ձեր այժմյան շեֆից ուղղված մեղադրանքներին հոդաբաշխ պատասխաններ տալը, սակայն լավ կլիներ վերանայեիք Ձեր մոտեցումը եւ ոչ վերաբերելի սուբյեկտներին Ձեր ֆեյսբուքյան մունետիկ չդարձնեիք։ Ի դեպ հոդաբաշխ պատասխանների մասին, դրանք նաեւ չհնչեցին 2018 թվականին եւս, երբ նույն դահլիճում ընդդիմությունը բարձրացնում էր իրոք թիրախային եւ մտորումների տեղիք տվող հարցեր։
Հասկանալով, որ ավելի հեշտ է ինձ արձագանքելը քան ձեր սահմանադրական առաքելությունն իրականացնելը, սպասում եմ հաջորդ պատասխանին՝ վեհանձն բարձրի դիրքերից իսկական տղամարդկային կանոններով: Բայց կներեք ես գերադասում եմ ինքս կարդալ համապատասխան ՄԻԵԴ որոշումները, քան ուրիշները ինձ պատմեն։ Ի դեպ ձեզ էլ խորհուրդ տալիս եմ»։
