POLITICSՀՀ ԱԺ նախկին պատգամավոր Մելիք Մանուկյանի՝ «Շշի Մելոյի» եղբորը բերման ենթարկելիս ոստիկանները գործել են իրավաչափ: Այս մասին հաղորդագրություն է տարածել ոստիկանության լրատվական ծառայությունը:
Ըստ ոստիկանության՝ օգոստոսի 4-ին մամուլում տարածվել էր օգոստոսի 3-ին ձերբակալված Աբովյանի 54-ամյա մի բնակչի փաստաբանի հայտարարությունը, ըստ որի՝ «ձերբակալվել և Կոտայքի մարզային ոստիկանության բաժանմունքում ծեծի է ենթարկվել ԱԺ նախկին պատգամավորներից մեկի եղբայրը՝ Ռոբերտ Մանուկյանը՝ Քրեական օրենսգրքի 38-332-րդ հոդվածով նախատեսված արարք կատարելու կասկածանքով»: Համացանցում հրապարակվել են նաև ձերբակալվածի մարմնի տարբեր մասերի լուսանկարներ, որոնցում երևում են կարմրավուն հետքեր։
Տեղեկացնենք, որ օգոստոսի 2-ին Կոտայքի մարզային քննչական վարչությունում արդարադատությանը խոչընդոտելու և իշխանության ներկայացուցչի նկատմամբ բռնություն գործադրելու հատկանիշներով քրեական գործ էր հարուցվել, որի շրջանակներում օգոստոսի 3-ին ոստիկանության Կոտայքի բաժնի ծառայողները այցելել էին Աբովյանում ապրող 54-ամյա մի տղամարդու բնակության հասցե' նրան հիշյալ քրեական գործով որպես կասկածյալ բերման ենթարկելու համար։ Տղամարդը դրսևորել էր ոչ իրավաչափ վարքագիծ ու չէր ենթարկվել ոստիկանության ծառայողների օրինական պահանջներին, ուստի ոստիկանները ստիպված ֆիզիկական ուժ էին կիրառել և հիշյալ տղամարդուն բերման ենթարկել բաժին։ Փաստաբանին հիշեցնենք «Ոստիկանության մասին ՀՀ օրենքի» 30-րդ հոդվածի բովանդակությունը, որը վերաբերվում է ֆիզիկական ուժի գործադրմանը։
Ոստիկանության ծառայողի օրինական պահանջներին չենթարկվելու կամ դիմադրություն ցույց տալու դեպքերում ոստիկանության ծառայողն իրավունք ունի գործադրել ֆիզիկական ուժ, այդ թվում` ձեռնամարտի հնարքներ: Հետևաբար ոստիկանության ծառայողները գործել են իրավաչափ և բերման ենթարկվողի գործողություններին համաչափ ուժ են կրառել։ Ընդ որում, ֆիզիկական ուժ կիրառվել է բացառապես նրան մեքենա նստեցնելիս և մեքենայից ոստիկանության Կոտայքի բաժին մտցնելիս։
Տեսագրությունում ակնհայտ երևում է, որ առանց ուժի կիրառման ոստիկանության ծառայողները չէին կարող կատարել օրենքով իրենց վերապահված պարտականությունը։ Ձերբակալվածի մարմնին առկա կարմրավուն հետքերի կապակցությամբ նշանակվել է դատաբժշկական փորձաքննություն և միայն փորձաքննության եզրակությամբ պարզ կլինի դրանց առաջացման պատճառները, ուստի նախապես անհիմն հայտարարություններ անելն իրավաբանին, մեղմ ասած՝ հարիր չէ, հատկապես, երբ բերման ենթարկելու տեսագրությունը վկայում է հակառակի մասին։
