Մարտի 1-ի գործի շրջանակներում այսպիսի մեղադրանքի պայմաններում այսպիսի որոշում կայացնելը հնարավոր է միայն մի դեպքում, եթե քրեական հետապնդումը չունի հեռանկար, իսկ առաջադրված մեղադրանքն էլ փաստացի տապալված է: Այս գործով մեղադրյալ Գեղամ Պետրոսյանին ազատ արձակելու որոշումն այսպես է մեկնաբանել փաստաբան Նորայր Նորիկյանը:
Իր ֆեյսբուքյան էջում փաստաբանը մասնավորապես գրել է.
«Այսօր ազատ է արձակվել 2008թ. ՀՀ ոստիկանության զորքերի հրամանատարի տեղակալի պաշտոնը զբաղեցրած Գեղամ Պետրոսյանը, ով ՀՀ քրեական օրենսգրքի 104-րդ հոդվածի 1-ին մասով նախատեսված հանցանք կատարելու` հրազենի գործադրմամբ մարտի 1-ի զոհերից Զաքար Հովհաննիսյանին դիտավորությամբ կյանքից զրկելու կասկածանքով ձերբակալվել, այնուհետև կալանավորվել էր ս.թ. հունիս ամսին:
Վարույթն իրականացնող մարմինը ընտրված խափանման միջոց կալանավորումը երկարացնելու վերաբերյալ համապատասխան միջնորդություն չի ներկայացրել դատարան:
