Արթուր Մկրտչյանը միաձայն ընտրվել է Երևան քաղաքի դատարանի նախագահ. ինչո՞վ է նա հայտնի
POLITICSԲարձրագույն դատական խորհուրդը օգոստոսի 2–ին գաղտնի քվեարկությամբ Երևան քաղաքի ընդհանուր իրավասության դատարանի նախագահ է ընտրել քրեական գործեր քննող դատավոր Արթուր Պետիկի Մկրտչյանին։ Այս մասին հայտնեց Բարձրագույն դատական խորհրդի անդամ Գրիգոր Բեքմեզյանը։
Մկրտչյանը դատարանի նախագահ է ընտրվել միաձայն։ Արթուր Մկրտչյանը հանրությանը հայտնի է ՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանին կալանավորելու գործով։ 2019 թվականի հունվարի 18–ին Արթուր Մկրտչյանը բավարարել էր ՀՔԾ քննիչի միջնորդությունը՝ Ռոբերտ Քոչարյանին կալանքի տակ պահելու ժամկետը երկարացնելու մասին և մերժել է պաշտպանների միջնորդությունը՝ կալանքն այլընտրանքային խափանման միջոց գրավով փոխարինելու մասին։
Մկրտչյանը հայտնի է նաև Հաց բերող Արթուր Սարգսյանի կալանքի գործով։ 2017թ. փետրվարի 9-ին հենց այս դատավորն է Սարգսյանի նկատմամբ երկրորդ անգամ կալանավորելու որոշում կայացրել։ Արթուր Մկրտչյանը եղել է նաև Արգիշտի Կիվիրյանի գործով դատավորը։
Նշենք, որ մեկ ամիս առաջ դադարեցվել էին Երևան քաղաքացի դատարանի նախագահ Ռուբեն Վարդազարյանի լիազորությունները, քանի որ նա ընտրվել էր ԲԴԽ նախագահ։
ՀՀ դատական օրենսգրքի համաձայն՝ առաջին ատյանի դատարանի նախագահի պաշտոնում թափուր տեղ առաջանալու օրվանից մեկշաբաթյա ժամկետում Դատական դեպարտամենտը կազմում և Բարձրագույն դատական խորհուրդ է ներկայացնում տվյալ առաջին ատյանի դատարանի բոլոր այն դատավորների ցուցակը, ովքեր տվյալ դատարանում ունեն դատավորի ոչ պակաս, քան երեք տարվա փորձառություն, չունեն կարգապահական տույժ, վերջին երեք տարվա ընթացքում չեն նշանակվել տվյալ դատարանի նախագահ և Բարձրագույն դատական խորհրդի անդամ չեն։
Բարձրագույն դատական խորհուրդն անցկացնում է գաղտնի քվեարկություն, որի ընթացքում յուրաքանչյուր անդամ ունի մեկ ձայնի իրավունք։ Քվեարկության արդյունքներով Հանրապետության նախագահին է առաջարկվում խորհրդի անդամների ընդհանուր թվի մեծամասնության ձայները ստացած անձը:
