Պետությունը խախտում է Ռոբերտ Քոչարյանի իրավունքները. փաստաբան
POLITICSՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանի գործի դատավարությունում ոչինչ չի կատարվում եւ դա մարդու իրավունքների ակնհայտ խախտում է: Օգոստոսի 7-ին մամուլի ասուլիսում այս մասին ասաց Ռոբերտ Քոչարյանի փաստաբան Արամ Օրբելյանը:
Փաստաբանը հիշեցրեց, որ Վերաքննիչ դատարանի՝ գործն առաջին ատյան վերադարձնելու հայտնի որոշումից, ինչպես նաեւ գործով դատավոր Դավիթ Գրիգորյանի լիազորությունները դադարեցնելուց հետո, նոր դատավոր չի նշանակվել եւ գործընթացը կասեցվել է:
Փաստացի նախկին նախագահը կալանավորվել է անժամկետ՝ իր կալանքի մասին որոշումը բողոքարկելու հնարավորություն չունենալով:
«Դա մադու իրավունքների խախտում է: Եվ կարեւոր չէ թե ով, որ ատյանն է խախտում՝ դատարանը, դատախազությունը կամ մեկ ուրիշը, կարեւոր է, որ դա անում է պետությունը՝ չապահովելով բնական գործընթացը», - ընդգծեց փաստաբանը:
Ընդ որում նա հիշեցրեց, որ խոսքը տվյալ դեպքում Ռոբերտ Քոչարյանի անձի մասին չէ, այլ պետության պաշտպանության մասին, որը հայտարարում է եվրոպական արժեքներին, մարդու իրավուքններին հավատարմության մասին՝ անկախ անձնական համակրանքից:
Փաստաբանի խոսքով՝ ՄԻԵԴ-ի 7 դիմումներին ի լրումն նրանք քննարկում են ՄԱԿ-ի Մարդու իրավունքների կոմիտե դիմելու հնարավորությունը եւ հետագա ներպետական քայլերը:
Փաստաբանը նորից ընդգծեց Ռոբերտ Քոչարյանի կալանքի անիրավաչափությունը մի հոդվածով, որի սահմանադրականությունը քննում է ՍԴ-ն, ինչպես նաեւ դատավոր Դավիթ Գրիգորյանի նկատմամբ գործողությունները, առավել եւս, որ եւ Վերաքննիչ դատարանը դատավորի աշխատասենյակում խուզարկությունն անթույլատրելի է համարել:
Փաստաբանը միաժամանակ քննադատեց որոշ պատգամավորների եւ իրավապահ մարմինների ներկայացուցիչների սուբյեկտիվ հայտարարությունները: Նրա խոսքով՝ փաստացի տեղի է ունենում վերադարձ խորհրդային «լավագույն» ավանդույթներին, երբ դատախազը միշտ ճիշտ էր, իսկ դատավորը պետք է աշխատեր դատախազի ցուցումով: Նրա խոսքով՝ ընդհանրապես անհասկանալի են դատական համակարգի վրա հարձակումները. ինչո՞ւ քննիչն ու իրավապահները միշտ լավն են, դատավորները վատը: Նա հիշեցրեց, որ նույն դատախազությունը դեռեւս մեկ տարի առաջ մարտի 1-ի գործի վերաբերյալ միանգամայն այլ կարծիքի էր: «Հարկավոր է բարեփոխումները սկսել ՀՔԾ-ից եւ դատախազությունից: ՀՔԾի եւ դատախազության համեմատությամբ դատական համակարգը շատ ավելի լավ վիճակում է»,- նշեց Արամ Օրբելյանը:
Փաստաբան Հովհաննես Խուդոյանը շեշտեց, որ Ռոբերտ Քոչարյանի պաշտպանությունը պահանջում է իր պաշտպանյալի իրավունքների կատարում եւ հրապարակային դատավարության շարունակում: Մենք պնդում ենք հրապարակային դատավարություն անցկացնել՝ անկախ դատավորի առկայությունից եւ դատախազության մասնակցությունից, բայց չպարզաբանեց, թե կոնկրետ ինչպես:
