«Հաղորդում հանցագործության մասին

BBC ռուսական ծառայության կողմից երեկ հրապարակված նյութին լուրջ չեմ վերաբերում հենց միայն այն պատճառով, որ այդպիսի բան նույնսկ տեականորեն չէր կարող լինել, հետևաբար հարկ չեմ համարում անդրադառնալ այս հոդվածում տեղ գտած ցնորամիտ դատողություններին, առավել ևս վերլուծել դրանք:

Սակայն ինձ այս նյութի հետ կապված հետաքրքրում է մեկ այլ հանգամանք, որը հիմնված է հետևյալ նախադասության վրա, որն իր մեջ պարունակում է հանցակազմի հատկանիշներ:

«Би-би-си получила эксклюзивный доступ к документам расследования одного из самых трагических событий в современной истории Армении: гибели 10 человек в Ереване во время протестов 1 марта 2008 года»:

Ի՞նչ է սա . . .

Ի՞նչպես է կարողացել օտարերկրյա լրատվամիջոցը «էքսկլյուզիվ» մուտք ունենալ նախաքննության նյութերին:

Ո՞վ է նրան տվել այդ հնարավորությունը:

ՀՔԾ-ը պետք է անհապաղ հայտարարութուն տարածի և, կ՛ամ հերքի այս պնդումը և մեղադրի BBC ռուսական ծառայությանը ստի մեջ, կ՛ամ էլ հաստատի, որ ինքն է տրամադրել նախաքննության նյութերը:

Եթե ՀՔԾ-ը հայտարարի, որ BBC ստում է և նրանց «էքսկլյուզիվ» հասանելություն չի տրամադրվել քրեական գործի նյութերին, ապա ՀՀ դատախազությունը պետք է քրեական գործ հարուցի՝ նախաքննական գաղտնիքը հրապարակելու փաստով և գտնի արտահոսք իրացրած անձին: Մեղադրանքը կարող է առաջադրվել ՀՀ Քր. օր-ի 342 հոդվածով, ինչպես նաև նույն օրենսգրքի 299 հոդվածով՝ պետական դավաճանություն:

Երկրորդ տարբերակի պարագայում հարցը, բացի ՀՀ Քր. օր.-ի 299 հոդվածից, ի հայտ է գալիս նաև խնդրի քաղաքական բաղադրիչը, որի համար պատասխանատվության պետք է ենթարկվի իշխանությունը՝ Վարչապետ Նիկոլ Փաշինյանի գլխավորությամբ:

Ցանկացած պարագայում ՀՀ գլխավոր դատախազությունը պետք է հարուցի քրեական գործ՝ ՀՀ քրեական օրենսգրքի 342 և 299 հոդվածների հատկանիշներով:

Եթե նախաքննության արդյունքում պարզվի, որ նախաքննության նյութերը օտարերկրյա լրատվամիջոցին տրամադրվել են քաղաքական որոշման արդյունքում, ապա գինը, որ կվճարի իշխանությունն ու անձամբ Նիկոլ Փաշինյանը, կլինի շատ ծանր և միայն իշխանության կորուստը ուղղակի փրկություն կլինի նրանց համար:
