BLOGԵս նախկինում առիթ էի ունեցել առաջարկել իմ պատկերացրած լուծումները Սահմանադրական դատարանի հետ կապված անցումային իրավիճակը հանգուցալուծելու նպատակով, մասնավորապես, առաջարկելով փոխել Սահմանադրության 213 հոդվածը, և ֆիքսված պաշտոնավարման ժամկետ սահմանել բոլոր դատավորների համար, սա արդարացի ելք կլիներ այսօր առաջացած երկիմաստ վիճակից։ Այդ մասին ֆեյսբուքյան գրառում է արել հանրային գործիչ, «Ազգային օրակարգ» կուսակցության համահիմնադիր Ավետիք Չալաբյանը:
«Դրա փոխարեն, գործող իշխանությունը որոշել է գնալ բացարձակ անհավանական տարբերակով՝ Սահմանադրական դատարանի դատավորներին բացահայտ կաշառք առաջարկելով կամավոր հրաժարականի դիմաց; Օգոստոսի 9-ին E-draft կայքի վրա հայտնվել է «Սահմանադրական դատարանի մասին օրենքում լրացումներ կատարելու մասին» օրենքի նախագիծը, որը, ի թիվս այլ վիճահարույց դրույթների, որոնք հնարավորություն են տալիս տարբեր ճնշումներ գործադրել դատավորների նկատմամաբ, ունի այսպես կոչված «Անցումային դրույթներ», որը ներկայացնում եմ ամբողջությամբ

1. 2019 թվականի օգոստոսի 1-ից մինչև հոկտեմբերի 31-ը հրաժարական ներկայացրած Սահմանադրական դատարանի դատավորի նկատմամբ անկախ տարիքից պահպանվում են իր հրաժարականի պահին ունեցած աշխատավարձը, դրա նկատմամբ սահմանված հավելավճարները և սոցիալական երաշխիքները, մինչև իր պաշտոնավարման տարիքը լրանալը, բացառությամբ նրա կողմից հանրային ծառայության անցնելու դեպքի։ Սահմանադրական դատարանի դատավորն իր պաշտոնավարման տարիքը լրանալուց հետո ստանում է օրենքով դատավորի համար նախատեսված կենսաթոշակ»
Սա մեր պատմության մեջ իսկապես աննախադեպ դրույթ է, երբ Սահմանադրական դատարանի դատավորին, կոնկրետ ժամկետներում հրաժարական տալու դիմաց, առաջարկվում է աշխատավարձ (ոչ թե կենսաթոշակ) մինչև իր 65 տարեկանը, ոչ թե նրա համար, որ նա աշխատի, և պաշտպանի սահմանադրությունը, այլ չաշխատի, և թույլ տա իշխանությանը նրա փոխարեն նշանակել իրեն հարմար դատավորներ։ Սա օրենքով բացահայտ կոռուպցիա խրախուսելու առաջին դեպքն է մեր պատմության մեջ, և դա փորձում է անել մի իշխանություն, որն անընդհատ խոսում է կոռուպցիայի բացառման մասին, սակայն հիմա մեր բոլորի վճարած հարկերի հաշվին, փորձում է կաշառել Սահմանադրական դատարանի գործող դատավորներին։
Ես չգիտեմ, թե ում հրաշք մտքի ծնունդ է սա, և չգիտեմ, թե արդյոք Սահմանադրական դատարանի որևէ դատավոր իր վարքագծով առիթ է տվել իշխանությանը մտածելու, որ նա պատրաստ է այդ կաշառքը վերցնելու, և դրանով վաճառելու մեր բոլորի օրինական իրավունքները։ Ես սակայն համոզված եմ, որ այս Ազգային ժողովի ցանկացած պատգամավոր, ով կողմ կքվեարկի այսպիսի «օրենքի», կհավասարվի և կգերազանցի իր կոռումպացված նախորդներին, իսկ Սահմանադրական դատարանի ցանկացած դատավոր, որը կօգտվի այսպիսի «օրենքից», մինչև իր կյանքի վերջ կկրի անսկզբունք կոռուպցիոների խարանը, և իրավունք չի ունենա այլևս նայել իր համաքաղաքացիների աչքերին։
Մինչ այդ, կոչ եմ անում մտնել e-draft կայքը, ուսումնասիրել և ձեր դիրքորոշումը արտահայտել այս խայտառակ նախագծին, հույսով, որ այն ծանրակշիռ հիմք կլինի իշխանությունների համար՝ հրաժարվել նրա հետագա առաջխաղացումից»,- գրել է Չալաբյանը։
