ՌԴ-ն չի հանձնի Միհրան Պողոսյանին. Դատախազություն
POLITICSՌԴ գլխավոր դատախազությունից ստացված տեղեկատվության համաձայն, Միհրան Պողոսյանին քրեական հետապնդման ենթարկելու նպատակով հանձնելու մասին ՀՀ գլխավոր դատախազության միջնորդության բավարարումը հնարավոր չի համարվել: Այս մասին հայտնում է Դատախազության հանրային կապերի բաժնի պետ Արեւիկ Խաչատրյանը:
«ՌԴ գլխավոր դատախազությունից ստացված տեղեկատվության համաձայն, Միհրան Պողոսյանին քրեական հետապնդման ենթարկելու նպատակով հանձնելու մասին ՀՀ գլխավոր դատախազության միջնորդության բավարարումը հնարավոր չի համարվել՝ հիմք ընդունելով «Քաղաքացիական, ընտանեկան և քրեական գործերով իրավական օգնության և իրավական հարաբերությունների մասին» 22.01.1993թ. Կոնվենցիայի 19-րդ հոդվածի դրույթները:
Կոնվենցիայի վերը նշված հոդվածը՝ որպես իրավական օգնություն ցույց տալու խնդրանքը լրիվ կամ մասնակիորեն մերժելու հիմք նախատեսում է այն դեպքերը, եթե այդպիսի օգնության ցուցաբերումը կարող է վնաս հասցնել հարցվող (կոնկրետ դեպքում ՝ հանձնման միջնորդությունը քննարկող) Պայմանավորվող Կողմի ինքնիշխանությանը կամ անվտանգությանը կամ հակասում է նրա օրենսդրությանը: Մինչդեռ, Միհրան Պողոսյանին քրեական հետապնդման ենթարկելու նպատակով հանձնելու մասին ՀՀ գլխավոր դատախազության միջնորդության մերժման կոնկրետ հիմքի վերաբերյալ հստակ տեղեկատվություն չի ներկայացվել: Վերոնշյալով պայմանավորված՝ ՀՀ գլխավոր դատախազությունը, ՌԴ գլխավոր դատախազությանն առաջարկել է տրամադրել հստակ տեղեկատվություն՝ Մ. Պողոսյանի հանձնումը մերժելու պատճառների վերաբերյալ»,- ասված է հայտարարությունում:
