ՍԴ–ն քննում է Ռոբերտ Քոչարյանին կալանավորելու հիմքերի սահմանադրականության հարցը (ուղիղ)
POLITICSՀՀ սահմանադրական դատարանը գրավոր ընթացակարգով քննում է ՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանի դիմումի հիման վրա` ՀՀ քրեական դատավարության օրենսգրքի 35-րդ հոդվածի եւ 135-րդ հոդվածի 2-րդ մասի` Ռոբերտ Քոչարյանի նկատմամբ խափանման միջոց կիրառելու հիմքերի եւ քրեական գործի վարույթը կամ քրեական հետապնդումը բացառող հանգամանքների սահմանադրականության հարցը։
Գործով զեկուցողներն են Սահմանադրական դատարանի դատավորներ Ա. Գյուլումյանը, Ա. Դիլանյանը, Ֆ. Թոխյանը, Ա. Թունյանը, Ա. Խաչատրյանը, Հ. Նազարյանը, Ա. Պետրոսյանը: Գործով որպես պատասխանող կողմ դատավարությանը ներգրավել նշված քրեական դատավարության օրենսգիրքն ընդունած մարմինը՝ Ազգային ժողովը:
ՍԴ դատավոր ընտրված Վահե Գրիգորյանը չի մասնակցի գործի քննությանը։
Համաձայն ՍԴ որոշման՝ Գրիգորյանի մասնակցությունը գործի քննությանն անհնարին է, քանի որ նա կանխակալ վերաբերմունք ունի որպես դիմող հանդես եկող սահմանադրական դատավարության մասնակիցների նկատմամբ, ինչպես նաեւ մասնակցել է հիշյալ գործերի քննությանն այլ դատարաններում։ Նշենք, որ Վահե Գրիգորյանը նախքան ՍԴ դատավոր նշանակվելը ներկայացնում էր «Մարտի մեկի» գործով տուժողների և նրանց իրավահաջորդների շահերը։
Հիշեցնենք որ Ռոբերտ Քոչարյանը մեղադրվում է ՀՀ քրեական օրենսգրքի 300.1-րդ հոդվածի 1-ին մասով և 311-րդ հոդվածի 4-րդ մասի 2-րդ կետով` ՀՀ սահմանադրական կարգը տապալելու և առանձնապես խոշոր չափերով կաշառք ստանալու մեջ: Երկրորդ նախագահը կալանավորվել է երեք անգամ։ Քոչարյանը երրորդ անգամ կալանավորվել է հունիսի 25-ին Վերաքննիչ քրեական դատարանի դատավոր Արմեն Դանիելյանի որոշմամբ։ Վերաքննիչի որոշմամբ Քոչարյանի և մյուսների գործը բեկանվել է և ուղարկվել առաջին ատյանի դատարան՝ նոր քննության։ Գործը մակագրվել է դատավոր Աննա Դանիբեկյանին։
