Ռոբերտ Քոչարյանի պաշտպանները ծանոթացել են ՍԴ որոշմանը. կմիջնորդեն նրան անհապաղ ազատել կալանքից
POLITICSՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանի պաշտպանները պատրաստվում են միջնորդություն ներկայացնել դատարան՝ երկրորդ նախագահի նկատմամբ ընտրված կալանավորումն անհապաղ վերացնելու պահանջով։ Այս մասին NEWS.am–ին հայտնեց Ռոբերտ Քոչարյանի պաշտպանական խմբի անդամ, փաստաբան Արամ Օրբելյանը։ Փաստաբանական թիմը նման որոշման է հանգել Ռոբերտ Քոչարյանի դիմումի հիման վրա ՍԴ որոշումից հետո։
Հիշեցնենք, որ սեպտեմբերի 4–ին ՍԴ–ն մասնակի բավարարեց ՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանի դիմումը։ Բարձր դատարանը ՀՀ քրեական դատավարության օրենսգրքի 35-րդ հոդվածի 2–րդ մասը ճանաչեց Սահմանադրությանը հակասող և անվավեր։ Այսպիսով արձանագրվեց, որ 35-րդ հոդվածի 2–րդ մասում նշված քրեական հետապնդումը բացառող հանգամանքների թվում անձեռնմխելիությանը վերաբերող կարգավորում առկա չէ, ինչը հակասահմանադրական է։ Իսկ այսօր արդեն ՍԴ կայքում հասանելի էր որոշման ամբողջական տեքստը, որում ներկայացված էր, թե ինչ հետևանքների է հանգեցրել պաշտոնաթող Հանրապետության նախագահի գործառութային անձեռնմխելիությանը վերաբերող դրույթն օրենսգրքում չամրագրելը։
«Սահմանադրական դատարանն արձանագրել է, որ պաշտոնաթող նախագահի գործառութային անձեռնմխելիությանը վերաբերող կարգավորումների բացակայությունը հանգեցրել է նրան, որ դատարաններն իրարամերժ որոշումներ են կայացրել, և սա այն հարցը չէ, որը հնարավոր էր մեկնաբանությամբ լուծել, հետևաբար որևէ դատարան չէր կարող խնդիրը լուծել մեկնաբանությամբ»,–ասաց փաստաբանը՝ ընդգծելով, որ օրենսդրական բացը չի կարող որևէ կերպ մեկնաբանվել ի վնաս անձի։
Արամ Օրբելյանի խոսքով՝ կարևոր է նաև այն, որ ՍԴ–ն համարել է, որ Սահմանադրության ուժով անձեռնմխելիությամբ օժտված և հատուկ պաշտպանություն ունեցող անձանց (ներառյալ՝ պաշտոնաթող Հանրապետության նախագահին) ներկայացվելիք մեղադրանքը, այդ թվում՝ հիմնավոր կասկածի տեսանկյունից, պետք է բավարարի իրավաչափության լրացուցիչ և նախնական պարտադիր պահանջը, այսինքն այդ անձանց մեղսագրվող արարքը, ներառյալ՝ դրա հիմքում դրված փաստերը չպետք է վերաբերեն այնպիսի գործողության կամ անգործության, որը բխում է կամ բխել է նրանց կարգավիճակից կամ գործունեությունից:
«Սա նշանակում է, որ առաջին ատյանի դատարանը սեպտեմբերի 12–ի նիստում պետք է անհապաղ անդրադառնա Ռոբերտ Քոչարյանի խափանման միջոցի հարցին և նրան ազատ արձակի»,–ընդգծեց Օրբելյանը։
Փաստաբանը նաև նշեց, որ ՍԴ որոշումից ակնհայտ է նաև, որ ՀՀ Քրեական դատավարության օրենսգիրքը փոփոխության ենթարկելու կարիք ունի։
