Դատարանը հրապարակում է ՀՀ երկրորդ նախագահի խափանման միջոցի վերաբերյալ որոշումը (ուղիղ)
POLITICSԵրեւանի Շենգավիթ վարչական շրջանի ընդհանուր իրավասության դատարանում՝ Աննա Դանիբեկյանի նախագահությամբ, սկսվել է երկրի երկրորդ նախագահ Ռոբերտ Քոչարյանին ազատելու միջնորդությամբ դատական նիստը:
Միջնորդության քննարկումը սկսվել էր սեպտեմբերի 12-ին:
Հիշեցնենք, որ Քոչարյանի փաստաբանները միջնորդել էին ՍԴ սեպտեմբերի 4-ի որոշման հիման վրա Քոչարյանի քրեական հետապնդման անհապաղ կասեցման եւ Հայաստանի երկրորդ նախագահի նկատմամբ ընտրված խափանման միջոցն անհապաղ վերացնելու մասին: Փաստաբան Արամ Օրբելյանը, մասնավորապես, հիշեցրել էր, որ ՍԴ-ն Սահմանդրությանը հակասող էր ճանաչել այն դրույթը, որի համաձայն քրեական հետապնդումը բացառող հանգամանքների թվում չի կանոնակարգվում անձի անձեռնմխելիությունը: Նա նաեւ հիշեցրել էր Սահմանադրության 3-րդ հոդվածը, որի համաձայն իշխանությունները պարտավոր են անհապաղ վերացնել Սահմանադրությամբ նախատեսված քաղաքացու իրավունքների խախտումները: Փաստաբանի խոսքով՝ քանի դեռ չի վերացվել օրենսդրական բացը, երկրորդ նախագահը պետք է անհապաղ ազատ արձակվի:
Ընդ որում՝ դատախազությունը եւ տուժած կողմը առարկություն են հայտնել Քոչարյանին ազատելու դեմ: Ավելի վաղ NEWS.am-ը հայտնել էր, որ սեպտեմբերի 4-ին ՍԴ-ն մասնակի բավարարել էր ՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանի դիմումը։ Բարձր դատարանը արձանագրել էր, որ ՀՀ քրեական դատավարության օրենսգրքի 35-րդ հոդվածը` Սահմանադրության ուժով հատուկ պաշտպանությամբ օժտված պաշտոնատար անձանց գործառութային անձեռնմխելիությունը՝ քրեական գործի վարույթը կամ քրեական հետապնդումը բացառող հանգամանքների թվում չնախատեսելու մասով, Սահմանադրության 27-րդ հոդվածի 1-ին մասի 4-րդ կետին, 61-րդ հոդվածի 1-ին մասին, 63-րդ հոդվածի 1-ին մասին եւ 78-րդ հոդվածին հակասող է:
Նախօրեին ԱԺ խոսնակ Արարատ Միրզոյանը դժգոհություն էր հայտնել ՍԴ-ի շուրջ ստեղծված իրավիճակի վերաբերյալ: Նրանից հետո արտահայտվել էր Նիկոլ Փաշինյանը՝ ՍԴ-ին մեղադրելով անկախ Հայաստանի պատմության մեջ բոլոր կեղծումներին մասնակցության մեջ: «Պետք է մտածել՝ ինչպես վարվել ՍԴ-ի հետ»,- հայտարարել էր վարչապետը:
