Միհրան Պողոսյանը որպես մեղադրյալ է ներգրավվել առանձնապես խոշոր չափերով փողերի լվացման համար
POLITICSՀՀ հատուկ քննչական ծառայությունում քննվող քրեական գործի շրջանակներում ՀՀ նախկին գլխավոր հարկադիր կատարող Միհրան Պողոսյանը որպես մեղադրյալ է ներգրավվել նաև ՀՀ քրեական օրենսգրքի 190-րդ հոդվածի 3-րդ մասի 1-ին կետով նախատեսված հանցավոր արարք կատարելու, այն է` հանցավոր ճանապարհով ստացված առանձնապես խոշոր չափերով գույքն օրինականացնելու /փողերի լվացման/ համար: Այս մասին հայտնեցին ՀՀ հատուկ քննչական ծառայությունից:
Այսպես, Միհրան Պողոսյանը ձեռնարկատիրական գործունեությանն ապօրինի մասնակցելու արդյունքում հանցավոր ճանապարհով ստացված, իր կողմից փաստացի կառավարվող մի շարք ընկերությունների գործունեության, ինչպես նաև «Քեթրին Գրուպ» ՍՊ ընկերության և դրա հետ փոխկապակցված այլ կազմակերպությունների կողմից առանձնապես խոշոր չափերով հարկեր չվճարելու հետևանքով ձեռք բերված առանձնապես խոշոր չափերով՝ 1.190.000 ԱՄՆ դոլարի ծագման իրական աղբյուրը թաքցնելու, խեղաթյուրելու և այդ գումարն օրինականացնելու նպատակով այն ձևակերպել է իբրև փոխառություն, փոխանցել «Քեթրին Գրուպ» ՍՊ ընկերության բանկային հաշվեհամարին և օգտագործել ընկերության ընթացիկ գործունեության, այդ թվում՝ վարկային պարտավորությունները մարելու համար:
Մասնավորապես, Մ. Պողոսյանի և «Քեթրին Գրուպ» ՍՊ ընկերության միջև 11.05.2015թ.-ին կնքված ձևական պայմանագրի համաձայն՝ Մ. Պողոսյանը ֆինանսական ժամանակավոր օգնություն տրամադրելու անվան տակ 500.000 ԱՄՆ դոլարի չափով անտոկոս փոխառությամբ դրամական միջոցներ է տրամադրել «Քեթրին Գրուպ» ՍՊ ընկերությանը, որից հետո` 2015թ.-ի մայիսի 11-ին և 26-ին, հիշյալ գումարից համապատասխանաբար 96.000.000 ՀՀ դրամին համարժեք 200.000 ԱՄՆ դոլարը և 143.700.000 ՀՀ դրամին համարժեք 300.000 ԱՄՆ դոլարը փոխանցել է փաստացի իրեն պատկանող «Քեթրին Գրուպ» ՍՊ ընկերության բանկային հաշվեհամարին:
Բացի այդ, Մ. Պողոսյանի կողմից փաստացի կառավարվող, Պանամայի Հանրապետության օֆշորային գոտում գրանցված ընկերության և «Քեթրին Գրուպ» ՍՊ ընկերության միջև 23.05.2015թ.-ին կնքված անտոկոս փոխառության պայմանագրի հիման վրա Մ. Պողոսյանի կողմից լիազորված անձը 329.130.000 ՀՀ դրամին համարժեք 690.000 ԱՄՆ դոլար է փոխանցել «Քեթրին գրուպ» ՍՊ ընկերության բանկային հաշվեհամարին:
Վերոհիշյալ գործողություններով Մ. Պողոսյանը թաքցրել է ապօրինի ձեռնարկատիրական գործունեությանն իր մասնակցության արդյունքում ձեռք բերված առանձնապես խոշոր չափերով՝ 568.830.000 ՀՀ դրամին համարժեք 1.190.000 ԱՄՆ դոլարի ծագման իրական աղբյուրը` այդպիսով օրինականացնելով այն:
Նախաքննությունը շարունակվում է: Քրեական գործով կատարվում են անհրաժեշտ քննչական գործողություններ` ենթադրաբար կատարված հանցագործություններն ամբողջ ծավալով բացահայտելու և մասնակիցների ողջ շրջանակը պարզելու ուղղությամբ:
Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
