Վերջին շրջանում նախաքննության ընթացքում առաջ են եկել նոր տեղեկություններ, նոր տվյալներ, որոնցով պայմանավորված անհրաժեշտություն է առաջացել շարունակելու նախաքննությունը։ Այս մասին այսօր՝ սեպտեմբերի 27-ին, ՀՀ Քննչական կոմիտեի նախագահի տեղակալ, Ամուլսարի վերաբերյալ քրեական գործով քննչական խմբի ղեկավար Արսեն Այվազյանը։

«Ցանկացած պահի ցանկացած նախադասություն, ցանկացած իրավիճակ, ցանկացած նոր իրավիճակ կարող է պատճառ լինել նախաքննությունը շարունակելու կամ ընդհուպ կայացված որոշումները վերանայելու։ Վերջին շրջանում նախաքննության ընթացքում առաջ են եկել նոր տեղեկություններ, նոր տվյալներ, որոնցով պայմանավորված անհրաժեշտություն է առաջացել շարունակելու նախաքննությունը»,–նշեց նա։

Հարցին՝ արդյոք նոր տվյալները նախկինում քննչական խմբի նախկին ղեկավար Յուրի Իվանյանի կողմից թաքցվել են, Այվազյանը նշեց.  «Պատճառների ու թաքցնելու մասին թույլ տվեք որեւէ իրավական գնահատական չտալ, պարզապես շարունակենք նախաքննությունը, որի արդյունքում կկայացնենք համապատասխան որոշումներ։ Նախաքննությունը շարունակելու հիմքը հանդիսանում է նախարարության կողմից ստացված գրությունը, որում առկա են նոր տվյալներ, որոնք անհրաժեշտ է քրեական գործի ընդհանրության մեջ դիտարկել, քննարկել եւ քննություն կատարել այդ տվյալները»։

Նա նշեց, որ քննության  ընթացքում հնարավոր է լրացուցիչ փորձաքննություն կամ կրկնակի փորձաքննություն նշանակվի։

«Քննում ենք մի քրեական գործ, որն իր ծավալով եւ բարդությամբ իր նախադեպը չունի, գործ ունենք նեզ մասնագիտական տերմինների, գործընթացների հետ խնդիր եւ մենք այլընտրանք չունենք, քան մասնագետներին դիմելու»,– ասաց Այվազյանը։

Նրա խոսքով՝ իրականացվել են նաեւ նոր հարցաքննություններ. «Հացաքննված նոր անձինք կան, նոր անձինք կլինեն, հնարավոր է նախկինում հարցաքննվածները հարցաքննվեն։ Մենք պետք է կատարենք լրացուցիչ հարցաքննություններ եւ այլ քննչական եւ դատավարական գործողություններ»։ 

ՔԿ նախագահի տեղակալը շեշտեց՝ այս փուլում գործը կարճելու մասին խոսք չկա։

Գործի շրջանակներում մեղադրանք առաջադրելու հնարավորության մասին  հարցին նա պատասծխանեց. «Անգամ մեկ ցուցմունքը կարող է քրեական գործում հեղաշրջում առաջացնել։ Նախաքննության գաղտնիությունը հաշվի առնելով թույլ տվեք չհրապարակել կա թե չկա»։

Հարցին՝ ինչով է պայմանավորված այդպիսի գաղտնիությունը, Այվազյանը պատասխանեց. «Չենք պատրաստվում նախաքննության հետագա ընթացքը տանել քողարկվածություն կամ ստվեր, բայց դա չի նշանակում, որ ամեն հարցաքննություն պետք է հրապարակային լինի»։

Նշենք, որ ՀՀ քննչական կոմիտեի ՀԿԳ քննության գլխավոր վարչությունում հարուցվել էր քրեական գործ՝ ՀՀ բնապահպանության նախարարության պաշտոնատար անձանց կողմից շրջակա միջավայրի աղտոտման մասին տեղեկությունները դիտավորությամբ թաքցնելու առերեւույթ դեպքի առթիվ։
