Մերի Մարգարյանի և նրա նորածնի մահվան գործով 2 բժիշկներն արդարացվել են. վճիռը կբողոքարկվի

«Շենգավիթ» ԲԿ-ում ծննդկան Մերի Մարգարյանի և նրա նորածնի մահվան գործով մեղադրվող բժիշկներից երկուսը՝ Տիգրան Սարգսյանը և Արամ Գրիգորյանն արդարացվել են: Այս մասին NEWS.am–ը տեղեկացավ դատական տեղեկատվական համակարգից։ Երևանի ընդհանուր իրավասության դատարանի դատավոր Մնացական Մարտիրոսյանի դատավճռով Տիգրան Սարգսյանը և Արամ Գրիգորյանը անմեղ են ճանաչվել ՀՀ քրեական օրենսգրքի 130-րդ հոդվածի 2-րդ մասով (Բժշկական սպասարկում իրականացնողների կողմից մասնագիտական պարտականությունները ոչ պատշաճ կատարելը, որն անզգուշությամբ առաջացրել է բուժվող հիվանդի մահ) նախատեսված հանցանքի կատարման մեջ և արդարացվել։ Նրանց նկատմամբ քրեական հետապնդումը դադարեցվել է հանցակազմի բացակայության հիմքով։
Ըստ մեղադրանքի՝ Տիգրան Սարգսյանը աշխատելով «Շենգավիթ» ԲԿ–ում որպես մանկաբարձ-գինեկոլոգ, 2015թ. հուլիսի 27-ին բժշկական օգնությունը և սպասարկումը կազմակերպելու ժամանակ, պարտավոր լինելով Մերի Մարգարյանին ցուցաբերել անհետաձգելի, առաջին բժշկական օգնություն, իր մասնագիտական պարտականությունների նկատմամբ անփույթ և անբարեխիղճ վերաբերմունքի հետևանքով դրանք իրականացրել է ոչ պատշաճ, որն անզգուշությամբ առաջացրել է Մերի Մարգարյանի, այնուհետև վերջինիս նորածնի մահը:
«Շենգավիթ» բժշկական կենտրոն ՓԲԸ-ի անեսթեզիոլոգ-ռեանիմատոլոգ Արամ Գրիգորյանն էլ է մեղադրվում իր մասնագիտական պարտականությունների նկատմամբ անփույթ և անբարեխիղճ վերաբերմունք դրսևորելու մեջ։
NEWS.am–ի հետ զրույցում տուժողի իրավահաջորդի ներկայացուցիչ Մարինե Թովմասյանը նշեց, որ դատվճռի դեմ բողոք են պատրաստում, որն առաջիկայում կներկայացնեն Վերաքննիչ դատարան։
Փաստաբանի խոսքով՝ դատարանն արձանագրել է, որ գործով ձեռք բերված ապացույցներով չի հիմնավորվել և չի փարատվել այն հարցը, թե բժիշկները կոնկրետ ի՞նչ գործողություններ էին պարտավոր իրականացնել, որը չեն արել, ինչն անզգուշաությամբ առաջացրել է տուժողի մահ։
Այդ փաստը որակվել է որպես չփարատված կասկած և մեկնաբանվել հօգուտ ամբաստանյալների։
Մինչդեռ փաստաբանի պնդմամբ՝ դատարանը պետք է գնահատեր և դատական ակտ կայացնելիս շեշտը դներ գործում առկա փաստերի, առաջին հերթին փորձագետների եզրակացության վրա, որով ասվում է, թե ինչ գործողություններ պետք է անեին բժիշկները, որոնց պայմաններում փրկվելու հավանականությունը մեծ էր։
Հիշեցնենք, որ Մերի Մարգարյանը մահացել է 2015թ.-ի հուլիսի 29-ին՝ «Էրեբունի» բժշկական կենտրոն տեղափոխվելով «Շենգավիթ» ԲԿ: 2 օր անց մահացել էր նաեւ Մերիի փոքրիկը: Մերի Մարգարյանի հղիությունը վարած, «Շենգավիթ» ԲԿ-ի մանկաբարձ-գինեկոլոգ Շուշանիկ Բախշյանի ու 2015թ.-ի հուլիսի 25-ի հերթապահ Անի Բաբելյանի մասով դատաքննությունը շարունակվում է: Նրանց վերաբերյալ գործով դեռևս նախորդ տարի օգոստոս ամսին նշանակվել է կրկնակի դատաբժշկական հանձնաժողովային փորձաքննություն։
