Երբ անձը դատավարական կարգավիճակ չունի, սակայն փաստացի ազատությունից զրկված է
SOCIETY«Փաստ» օրաթերթը շարունակում է ներկայացնել «Ճանաչեք և պաշտպանեք ձեր իրավունքները» խորագիրը: Շատ են դեպքերը, երբ քաղաքացիները չեն կարողանում պաշտպանել իրենց իրավունքները, քանի որ իրազեկված չեն, իսկ երբեմն էլ որոշ պետական հիմնարկներ էլ ավելի են շփոթեցնում նրանց:
Օրաթերթը, համագործակցելով ՀՀ փաստաբանների պալատի հետ, այսուհետ հանրային իրազեկման արշավ է կազմակերպում, որը կօգնի մեր քաղաքացիներին իմանալ և պաշտպանել իրենց իրավունքները: Նշենք նաև, որ յուրաքանչյուր հինգշաբթի՝ ժամը 10:00-ից մինչև 17:00-ն փաստաբանների պալատի հանրային պաշտպանի գրասենյակն անվճար խորհրդատվություն է տրամադրում ՀՀ բոլոր քաղաքացիներին:
Հարց.-Որո՞նք են դատավարական կարգավիճակ չունեցող, սակայն փաստացի ազատությունից զրկված անձանց իրավունքները:

ՀՀ Սահմանադրության 16-րդ հոդվածի համաձայն` «Յուրաքանչյուր ոք ունի անձնական ազատության և անձեռնմխելիության իրավունք:
Մարդուն կարելի է ազատությունից զրկել օրենքով սահմանված դեպքերում և կարգով»:
Այնուհետև թվարկվում է անձին ազատությունից զրկելու իրավաչափ դեպքերի սպառիչ ցանկը, որոնց թվում է «հանցագործություն կատարած լինելու հիմնավոր կասկածը»:
ՀՀ քրեական դատավարության օրենսգիրքը նախատեսում է ենթադրաբար հանցագործություն կատարած լինելու հիմքով անձին ազատությունից զրկելու երկու ինքնուրույն միջոցներ` ձերբակալումը և խափանման միջոց կալանավորումը:
Ձերբակալման ընթացակարգի յուրահատկությունը հաշվի առնելով` հանցագործություն կատարած լինելու հիմնավոր կասկածով անձին ազատությունից զրկելու կառուցակարգը կարող է ընդգրկել որոշակի տևողությամբ սկզբնական փուլ, որի ընթացքում անձը կարող է որևէ դատավարական կարգավիճակ չունենալ՝ պայմանավորված գործող քրեադատավարական օրենսդրության անբավարար որոշակիությամբ:
Մինչդատական վարույթում «ձերբակալվածի» և «կալանավորվածի» կարգավիճակների հետ մեկտեղ ազատությունից զրկված անձը կարող է ունենալ նաև նախնական իրավական վիճակ, որը պայմանականորեն կարելի է անվանվել «բերվածի» կարգավիճակ:
Մարդու իրավունքների եվրոպական դատարանի իրավական դիրքորոշումների հիման վրա Վճռաբեկ դատարանը գտել է, որ բերվածի իրավական վիճակը համապատասխանում է «քրեական մեղադրանքի» ներկայացման Կոնվենցիոն պահանջին` Եվրոպական դատարանի բովանդակային մեկնաբանմամբ:
Ուստի բերվածի կարգավիճակի առանձնահատկությունները հաշվի առնելով` բերված անձը պետք է օժտված լինի առնվազն հետևյալ իրավունքներով
ա) իմանալու իրեն արգելանքի վերցնելու պատճառը,
բ) տեղեկացնելու իրեն բերման ենթարկելու մասին,
գ) հրավիրելու իր փաստաբանին,
դ) լռելու:
Համապատասխանաբար, քրեական հետապնդման մարմինը պարտավոր է ապահովել բերվածի իրավունքների իրականացումը` բերվածի իրավունքները գրավոր պարզաբանելու, նրան առնվազն մեկ զանգի հնարավորություն ընձեռելու, բերվածի փաստաբանի մուտքը չխոչընդոտելու եղանակներով:
