«Մի քանի անգամ ընդգծելով «խորհրդատվական կարծիք» եզրույթը՝ դրանից իրավիճակը չի փոխվում»

ՄԻԵԴ Մեծ պալատում ձևավորվել է 17 դատավորներից բաղկացած հանձնաժողով՝ Ռոբերտ Քոչարյանի գործով ՍԴ-ին խորհրդատվական կարծիք տալու համար։ Սահմանադրական իրավունքի մասնագետ Արամ Վարդևանյանը նախ ընդգծում է.
«Սույն գործով ՄԻԵԴ նախագահն արձանագրել է, որ այն ունի հրատապության բնույթ:
Այն սեղմ ժամկետների շրջանակներում քննվող գործ է Եվրոպական դատարանի բարձրագույն պալատում: ՍԴ-ում երկու կողմ կա, ԱԺ-ն՝ որպես պատասխանող, և Ռոբերտ Քոչարյանը՝ որպես դիմող կողմ:
Երկու կողմերն էլ ունեն հնարավորություն իրենց դիրքորոշումը ներկայացնել մինչև նոյեմբերի 19-ը»,-ասաց նա՝ հավելելով, որ կառավարությունը, ինչպես նաև Եվրոպայի խորհրդի մարդու իրավունքների հանձնակատարը կամ այլ մասնակիցներ, որոնք ցանկություն կհայտնեն իրենց դիրքորոշումը հայտնել, նրանց դեպքում վերջնաժամկետը դեկտեմբերի 4-ն է:
ՄԻԵԴ-ում կառավարության ներկայացուցիչ Եղիշե Կիրակոսյանի հարցազրույցից պարզ դարձավ, որ կառավարությունը դիրքորոշում հայտնելու ցանկություն ունի, բայց մի հանգամանքի մասին եմ ուզում նշել:
Նա մի քանի անգամ ընդգծեց, որ սա, ի վերջո, խորհրդատվական բնույթի կարծիք է: Իհարկե, խորհրդատվական բնույթի է, բայց հարց է առաջանում` քանի՞ երկիր կա, որ եվրոպական դատարանի բարձրագույն պալատի խորհրդատվական կարծիքը կարող է դիտարկել սոսկ որպես խորհրդատվական կարծիք:
Չեմ կարծում, որ այդպիսի փորձ կա. եվրոպական դատարանի բարձր պալատի կարծիքը, որը, անշուշտ, խորհրդատվական է, վերաբերում է իրավունքի խախտմանը կամ բացակայությանը, համապատասխանությանը կամ անհամապատասխանությանը կոնվենցիային:
Իսկ թե մեր Սահմանադրության տեսանկյունից ի՞նչ իրավիճակ է ենթադրում այն, պատասխանը պարզ է. կոնվենցիոնալ իրավունքներն ամրագրված են մեր Սահմանադրության մեջ, հետևաբար, կոնվենցիոնալ երաշխիքները նաև սահմանադրական երաշխիքներ են»,-«Փաստի» հետ զրույցում ասաց Ա. Վարդևանյանը:
Նա շեշտեց, որ 2015թ. Սահմանադրությամբ ընդգծվել է հետևյալը.
«Հիմնական իրավունքների և ազատությունների վերաբերյալ Սահմանադրությունում ամրագրված դրույթները մեկնաբանելիս հաշվի է առնվում ՀՀ վավերացրած՝ մարդու իրավունքների վերաբերյալ միջազգային պայմանագրերի հիման վրա գործող մարմինների պրակտիկան: Սա նշանակում է, որ երբ հայաստանյան պրակտիկան իրավունք է մեկնաբանում, ապա հաշվի 1 առնում Եվրոպական դատարանի պրակտիկան: Հետևաբար, այս պարագայում մի քանի անգամ ընդգծելով խորհրդատվական կարծիք եզրույթը՝ դրանից իրավիճակը չի փոխվում»: Ա. Վարդևանյանը հավելեց.
