«Փաստ» օրաթերթը շարունակում է ներկայացնել «Ճանաչեք և պաշտպանեք ձեր իրավունքները» խորագիրը: Շատ են դեպքերը, երբ քաղաքացիները չեն կարողանում պաշտպանել իրենց իրավունքները, քանի որ իրազեկված չեն, իսկ երբեմն էլ որոշ պետական հիմնարկներ էլ ավելի են շփոթեցնում նրանց:

Օրաթերթը, համագործակցելով ՀՀ փաստաբանների պալատի հետ, այսուհետ հանրային իրազեկման արշավ է կազմակերպում, որը կօգնի մեր քաղաքացիներին իմանալ և պաշտպանել իրենց իրավունքները: Նշենք նաև, որ յուրաքանչյուր հինգշաբթի՝ ժամը 10:00-ից մինչև 17:00-ն փաստաբանների պալատի հանրային պաշտպանի գրասենյակն անվճար խորհրդատվություն է տրամադրում ՀՀ բոլոր քաղաքացիներին:

Հարց-Ո՞ր գույքն է համարվում ամուսինների համատեղ սեփականություն:

Ամուսնության ընթացքում ամուսինների ձեռք բերած գույքը նրանց համատեղ սեփականությունն է, եթե այլ բան նախատեսված չէ օրենքով կամ նրանց միջև կնքված պայչէ օրենքով կամ նրանց միջև կնքված պայմանագրով:

Մինչև ամուսնությունն ամուսիններից յուրաքանչյուրի գույքը, ինչպես նաև ամուսնության ընթացքում ամուսիններից մեկի նվեր կամ ժառանգություն ստացած գույքը նրա սեփականությունն է:

Նվեր կամ ժառանգություն ստացած գույքը ամուսինների ընդհանուր գույք չի համարվում, քանի որ տվյալ դեպքում բացակայում է ամուսինների համատեղ ներդրումը գույքը ձեռք բերելու հարցում:

Անհատական օգտագործման գույքը (հագուստը, կոշիկը և այլն), եթե նույնիսկ այն ձեռք է բերվել ամուսնության ընթացքում ամուսինների ընդհանուր միջոցների հաշվին, համարվում է այն ամուսնու սեփականությունը, որն այդ գույքն օգտագործել է, բացառությամբ թանկարժեք իրերի և պերճանքի առարկաների:

Ամուսիններից յուրաքանչյուրի գույքը կարող է ճանաչվել նրանց համատեղ սեփականություն, եթե պարզվի, որ ամուսնության ընթացքում ամուսինների ընդհանուր գույքի կամ մյուս ամուսնու անձնական գույքի հաշվին կատարվել են ներդրումներ, որոնք նշանակալի չափով ավելացրել են այդ գույքի արժեքը (հիմնական վերանորոգում, վերակառուցում, վերասարքավորում և այլն), եթե այլ բան նախատեսված չէ ամուսինների միջև կնքված պայմանագրով:

Օրինակ՝ կինը մինչև ամուսնանալը ունեցել է մեկ հարկանի բնակելի տուն, իսկ ամուսնությունից հետո տղամարդը, իր անձնական գույքի հաշվին կամ ամուսինների ընդհանուր գույքի հաշվին ներդրում կատարելով, բնակելի տանը ավելացրել է երկրորդ հարկ: 

Տվյալ դեպքում բնակելի տունը կարող է ճանաչվել ամուսինների համատեղ սեփականություն:

Ամուսիններից մեկի պարտավորությունների համար կարող է բռնագանձում տարածվել ամուսինների ընդհանուր գույքում նրա բաժնի վրա:
