Մանրամասներ ժառանգության ստացման մասին

«Փաստ» օրաթերթը շարունակում է ներկայացնել «Ճանաչեք և պաշտպանեք ձեր իրավունքները» խորագիրը: Շատ են դեպքերը, երբ քաղաքացիները չեն կարողանում պաշտպանել իրենց իրավունքները, քանի որ իրազեկված չեն, իսկ երբեմն էլ որոշ պետական հիմնարկներ էլ ավելի են շփոթեցնում նրանց:

Օրաթերթը, համագործակցելով ՀՀ փաստաբանների պալատի հետ, այսուհետ հանրային իրազեկման արշավ է կազմակերպում, որը կօգնի մեր քաղաքացիներին իմանալ և պաշտպանել իրենց իրավունքները: Նշենք նաև, որ յուրաքանչյուր հինգշաբթի՝ ժամը 10:00-ից մինչև 17:00-ն փաստաբանների պալատի հանրային պաշտպանի գրասենյակն անվճար խորհրդատվություն է տրամադրում ՀՀ բոլոր քաղաքացիներին:

Հարց.- Ի՞նչ տարբերություն ներկայացման իրավունքով գույքը ժառանգելու և ժառանգության տրանսմիսիայի միջև:

Պատասխանում է փաստաբան Նաիրա Համբարձումյանը:

- Ներկայացման իրավունքով ժառանգումը տեղի է ունենում միայն ըստ օրենքի ժառանգելիս: Մինչդեռ ժառանգական տրանսմիսիայի կարգով ժառանգում տեղի է ունենում և՛ ըստ օրենքի, և՛ ըստ կտակի ժառանգման դեպքում:

- Ժառանգական տրանսմիսիայի կարգով ժառանգել կարող են ժառանգատուի այն ժառանգի ժառանգները, ով չի հասցրել ընդունել իր օգտին բացված ժառանգությունը կամ հրաժարվել ժառանգությունից: 

Իսկ ներկայացման իրավունքով ժառանգել կարող են միայն ժառանգների զավակները, այսինքն՝ ժառանգատուի թոռները, ժառանգատուի քույրերի ու եղբայրների զավակները, ժառանգատուի հորաքույրների, հորեղբայրների, մորաքույրների, մորեղբայրների զավակները:

- Ժառանգական տրանսմիսիայի կարգով ժառանգելու դեպքում պետք է ժառանգը մահացած լինի ժառանգատուի մահվանից հետո՝ չհասցնելով ընդունել ժառանգությունը, մինչդեռ ներկայացման իրավունքով ժառանգելու դեպքում ժառանգը մահացած է լինում մինչև ժառանգության բացվելը, այսինքն` ժառանգատուից շուտ է մահանում:

-Ժառանգական տրանսմիսիայի կարգով և ներկայացման իրավունքով ժառանգումների միջև առկա է ևս մեկ էական տարբերություն.

- Ժառանգական տրանսմիսիայի կարգով և ներկայացման իրավունքով ժառանգումների միջև էական տարբերություն կա նաև կապված ժառանգական զանգվածի հետ: 

Ժառանգական տրանսմիսիայի դեպքում ժառանգը ստանում է այն գույքն իր ակտիվով և պասիվով, որը պետք է ստանար նախորդող ժառանգը, ում ժառանգն է ինքը: 

Դրա համար էլ իրեն հասած ժառանգության սահմաններում նա պատասխանատու է ինչպես իր, այնպես էլ իրեն նախորդողի ժառանգատուի պարտքերի համար: 

Դրան հակառակ ներկայացման իրավունքով ժառանգելիս թոռները ժառանգական գույք են ստանում պապի կամ տատի մահվանից հետո՝ անկախ ժառանգման կարգով իրենց ծնողներից նախկինում ստացած ժառանգությունից: 

Ուստի նրանք պատասխանատու չեն իրենց հոր կամ մոր պարտքերի համար այն գույքով, որ ստացել են ներկայացման իրավունքով ժառանգելու ժամանակ պապի (տատի) մահվանից հետո:
