«Վարդաշեն» քրեակատարողական հիմնարկի վարչակազմը ԱԺ «Լուսավոր Հայաստան» խմբակցության քարտուղար Գեւորգ Գորգիսյանին եւ նույն խմբակցության պատգամավոր Անի Սամսոնյանին թույլ չի տվել տեսակցել ԱԺ աշխատակազմի ղեկավարի նախկին տեղակալ Արսեն Բաբայանին: Այս մասին այսօր՝ հոկտեմբերի 25-ին, ֆեյսբուքյան իր էջում ուղիղ եթերով հայտարարեց Գեւորգ Գորգիսյանը։

 

«Ինչպես գիտեք, դատարանը եւս այդ ձերբակալումը ոչ իրավաչափ համարեց, սակայն նաեւ բավարարեց միջնորդությունը, որպեսզի Արսեն Բաբայանին 2 ամսով կալանավորեն: Իրավիճակը հասկանալու համար մենք եկել էինք, որպեսզի տեսակցեինք պարոն Բաբայանին եւ տեղում նրանից պարզեինք իր մոտեցումները»,- ասաց Գորգիսյանը։

 

 

Գորգիսյանը հիշեց նաեւ ժամանակին երբ «Ելք» դաշինքը կար վարչապետ Նիկոլ Փաշինյանը եւ  ԼՀԿ ղեկավար Էդմոն Մարուքյանը փորձում էին այցելել «Սասնա ծռեր» կուսակցության անդամ «Սասնա ծռեր» համահայկական շարժման ղեկավար-անդամ Ժիրայր Սեֆիլյանին՝ մեծ աղմուկ բարձրացավ. «Հենց այս հոդվածին հղում անելով փորձում էին նրանց թույլատրել»։

 

Հիշեցնենք, որ Երեւան քաղաքի ընդհանուր իրավասության դատարանը՝ նախագահությամբ Կարեն Ֆարխոյանի որոշում է կայացրել բավարարել ՀՔԾ քննիչի միջնորդությունը եւ երկու ամսով կալանավորել  ԱԺ աշխատակազմի ղեկավարի նախկին տեղակալ Արսեն Բաբայանին։ Դատարանը միաժամանակ ոչ իրավաչափ ճանաչեց Բաբայանին ձերբակալելու որոշումը։ Հիշեցնենք` Բաբայանը ձերբակալվել է հոկտեմբերի 21–ին ՀՀ քրեական օրենսգրքի 314-րդ հոդվածի 1-ին մասով (պաշտոնեական կեղծիք կատարելը)  նախատեսված հանցագործություն կատարելու կասկածանքով: Հաջորդ օրը ՀՔԾ–ն Արսեն Բաբայանին մեղադրանք առաջադրեց ՀՀ քրեական օրենսգրքի 38-300-րդ հոդվածի 1-ին մասով (իշխանության յուրացման օժանդակելը) եւ 314-րդ հոդվածի 1-ին (պաշտոնեական կեղծիք կատարելը)   մասով նախատեսված այն հանցավոր արարքների կատարման համար, որ նա, 2018 թվականին հանդիսանալով ՀՀ ազգային ժողովի աշխատակազմի ղեկավարի տեղակալի պաշտոնակատար, օժանդակել է մի խումբ պաշտոնատար անձանց կողմից ՀՀ սահմանադրական դատարանի լիազորություններին տիրանալուն, ինչպես նաեւ կատարել է պաշտոնեական կեղծիք: Ըստ մեղադրանքի՝ Բաբայանը   խեղաթյուրել է Գագիկ Հարությունյանի դիմումն իրականում 2018 թվականի մարտի 5-ին ԱԺ մուտք լինելու հանգամանքը, մուտքագրման ամսաթիվը նշելով 2018 թվականի մարտի  2-ը։ Այս եղանակով Արսեն Բաբայանը պայմաններ՝ կեղծ հիմքեր է ստեղծել Սահմանադրական դատարանի լիազորություններին տիրանալու նպատակով ԱԺ նախագահ Արա Բաբլոյանի՝ 2018 թվականի մարտի 2-ին ստորագրած ՍԴ նախագահ Գագիկ Հարությունյանի հրաժարականի դիմում ներկայացնելու մասին հայտարարությունը հրապարակելու համար, որն էլ իր հերթին հիմք է հանդիսացել վերջինիս լիազորությունները դադարեցնելու, իսկ հետագայում` այդ թափուր պաշտոնում Հրայր Թովմասյանին առաջադրելու ու նշանակելու գործընթացի համար:
