Սահմանադրական դատարանի շուրջ ընթացող գործընթացները դարձել են հայկական քաղաքական հարթակի առաջնային հարցերից մեկը, եթե ոչ ամենաառանցքայինը։ 

Չնայած այն փաստին, որ իշխանությունները հնարավոր ու անհնար ճանապարհներով ձեռնամուխ են եղել ազատվել ՍԴ նախագահ Հրայր Թովմասյանից, սակայն նրանց նախաձեռնությունները չեն ունենում իրենց համար փափագելի արդյունքը։ 

Մենք նախորդ հրապարակումներում արդեն գրել ենք, որ Նիկոլ Փաշինյանը մի քանի փակ քննարկումներ է ունեցել, որոնց ներկա են գտնվել նաև միջազգային փորձագետներ ու սահմանադրագետներ։

Թերթի աղբյուրի փոխանցմամբ, այդ հանդիպումների արդյունքում արդեն իսկ նախնական քաղաքական որոշում է կայացվել, ըստ որի, հնարավոր կլինի ոչ միայն ազատվել Թովմասյանից, այլ նաև ամբողջությամբ վերացնել Սահմանադրական դատարանը՝ որպես ինստիտուտ։ 

Պատահական չէ, որ իշխանամերձ փորձագիտական շրջանակները վերջին օրերին ավելի ու ավելի հաճախ են այս թեզը նետում շրջանառության մեջ։ Նման գործելաոճն ընդունված է միջազգային պրակտիկայում. այսպես կոչված՝ «օվերտոնի պատուհանի» սկզբունքով հանրության ականջին աստիճանաբար հնչեցվում են իշխանության քիմքին հաճելի թեզեր, որոնք ժամանակի ընթացքում ստանում են ավելի հաճախակի բնույթ, հետագայում արդեն՝ հստակ օրենքի տեսք։ 

Այսպես, «Փաստ» թերթի տեղեկություններով, ՍԴ-ն որպես ինստիտուտ ՀՀ դատաիրավական համակարգից վերացնելու մասին դրույթն առաջիկայում կսկսի ավելի հաճախ շրջանառվել, և, ըստ ամենայնի, դրա մասին կբարձրաձայնվի միայն գարնանը, ապա և քննարկման կներկայացվի համապատասխան նախագիծը։ 

Ի դեպ, տարբերակներից մեկը ՍԴ-ի և Վճռաբեկ դատարանի լիազորությունների միավորումն է և, ըստ այդմ, նոր Բարձր դատարանի ձևավորումը:
