ԱԺ հանձնաժողովը հավանություն տվեց ԶՈւ-ում կարգապահական իրավախախտումներին առնչվող նախագծին

ՀՀ ազգային ժողովի պաշտպանության և անվտանգության հարցերի մշտական հանձնաժողովը հավանություն տվեց կառավարության կողմից ներկայացված օրենքի նախագծին, որով մասնավորապես առաջարկվում է կարգապահական իրավախախտում հայտնաբերելու դեպքում կարգապահական տույժի կիրառման առավելագույն ժամկետը երկարացնել: «Հայաստանի Հանրապետության զինված ուժերի կարգապահական կանոնագիրք» Հայաստանի Հանրապետության օրենքում փոփոխություններ եւ լրացումներ կատարելու մասին օրենքի նախագիծը հանձնաժողովում ներկայացրեց ՀՀ պաշտպանության փոխնախարար Գաբրիել Բալայանը:
«Սահմանվում է կարգապահական իրավախախտում հայտնաբերելու դեպքում կարգապահական տույժի կիրառմամբ առավելագույն ժամկետը: Մասնավորապես 6 ամիսը փոխարինվում է 1 տարով, իսկ նյութական վնասի հայտնաբերման դեպքում՝ 3 տարի: Երբեմն լինում է, որ դեպքից 6 ամիս անցնում է, հետո համալիր ստուգման, որոշակի պաշտոնի հանձնման-ընդունման ընթացքում է միայն այն հայտնաբերվում: Բայց այդ դեպքում, քանի որ 6 ամիսն անցնել է, այլևս հնարավորություն չկա կարգապահական տույժի ենթարկելու»,-ասաց Բալայանը:
Գործող օրենքով կարգապահական իրավախախտման համար պատասխանատվությունը ծանրացնող հանգամանք է այն, եթե այն կատարվել է նախկինում հանցագործություն կատարած զինծառայողի կողմից: Դրա փոխարեն առաջարկվում է որպես ծանրացնող հանգամանք համարել այն, եթե իրավախախտումը կատարվել է դատվածություն ունեցող զինծառայողի կողմից: Նախատեսվում է կարգապահական տույժի տրման վերաբերյալ զինծառայողին պարտադիր տեղեկացնելու, ինչպես նաև ծառայողական քննությանը մասնակցելու պահից իրավունքներին ու պարտականությունների գրավոր ծանոթացնելու պահանջը: Բալայանը նշեց՝ նախկինում դա չկար, ինչի արդյունքում բողոքները շատ էին լինում:
Նախագծով սահմանվում են ծառայողական քննության և կասեցման հիմքերը: Օրինագծով նախատեսվում են նաև մի շարք այլ կարգավորումներ ևս: Բալայանը նշեց, որ միջգերատեսչական երկարատև քննարկումներից հետո կառավարությունը հավանություն է տվել օրենքի նախագծին:
