Ալեն Սիմոնյանն առաջարկում է պատասխանատվություն սահմանել արմատից հատված եղեւնիների եւ սոճիների վաճառքի համար

ՀՀ ԱԺ փոխնախագահ Ալեն Սիմոնյանն առաջակում է վարչական պատասխանատվություն սահմանել բացօթյա առեւտուր իրականացնող վաճառողի կողմից ամանորյա տոնակատարությունների համար նախատեսված արմատից հատված եղեւնիների եւ սոճիների վաճառքի համար։

«Հոդված 1. Վարչական իրավախախտումների վերաբերյալ Հայաստանի Հանրապետության 1985 թվականի դեկտեմբերի 6-ի օրենսգրքի 158-րդ հոդվածը լրացնել հետեւյալ բովանդակությամբ.

«Բացօթյա առեւտուր իրականացնող վաճառողի կողմից ամանորյա տոնակատարությունների համար նախատեսված արմատից հատված եղեւնիների եւ սոճիների վաճառքը, որեւէ կերպ դրանց օտարումը կամ առեւտրային նպատակներով ցուցադրումը՝

առաջացնում է տուգանքի նշանակում՝ սահմանված նվազագույն աշխատավարձի երեքհարյուրապատիկից մինչեւ հինգհարյուրապատիկի չափով:

Առեւտրի օբյեկտների եւ առեւտրի իրականացման վայրում ամանորյա տոնակատարությունների համար նախատեսված արմատից հատված եղեւնիների եւ սոճիների վաճառքը, որեւէ կերպ դրանց օտարումը կամ առեւտրային նպատակներով ցուցադրումը՝

առաջացնում է տուգանքի նշանակում՝ սահմանված նվազագույն աշխատավարձի հինգհարյուրապատիկի չափով:»

Հոդված 2. Սույն օրենքն ուժի մեջ է մտնում պաշտոնական հրապարակման օրվան հաջորդող տասներորդ օրը»,-նշված է առաջարկվող փոփոխության մեջ:

Ըստ նախագծի հիմնավորման՝ ներկայիս նորմատիվ իրավական դաշտը չի կարգավորում արմատից որեւէ կերպ հատված ծառերի վաճառքի սահմանափակում․  «Բուսական աշխարհը ինքնին պաշտպանված է օրենքով, սակայն ապօրինի հատված ծառերն ինքնըստինքյան հայտնվում են շուկայում:  Բացի այդ, ներկայիս կարգավորմամբ բացակայում են օրենսդրական խոչընդոտները ապօրինի հատված եղեւնի եւ սոճիների վաճառքի վերաբերյալ: Ռիսկային է թույլատրել հատված եղեւնիների եւ սոճիների վաճառքը, քանի որ մեծ է հավանականությունը ապօրինի հատումների: Առեւտրի եւ ծառայությունների ոլորտը կարգավորող օրենքում թույլատրվում է ամանորյա տոնակատարությունների համար եղեւնիների եւ սոճիների վաճառքը, սակայն չի հստակեցվում դրանց վաճառահանման կանոնները, ինչպես նաեւ ծագումը: Ստացվում է մի իրավիճակ, երբ օպիրինի հատված նման ծառերը կարող են անարգել վաճառվել:

Առաջարկվող կարգավորումները վերաբերում են «Առեւտրի եւ ծառայության մասին»  ՀՀ օրենքին եւ ՀՀ ՔՕ-ին, որով կսահմանափակի հատված եղեւնիների եւ սոճիների վաճառքը, բայցի այդ, որպես ածանցյալ ռիսկերից խուսափելու միջոց, առաջարկվում է նաեւ սահմանափակել վերջիններիս առեւտրային նպատակներով  պահեստավորումը եւ ցուցադրումը: Նորմի խախտումը առաջարկվում է որակել որպես զանցանք, ինչի համար ՎԻՎՕ-ում 158-րդ հոդվածի լրացման առաջարկ է կատարվել: Վարչական պատասխանատվությունը ներառում է տուգանքի նշանակում  նվազագույն աշխատավարձի երեքհարյուրապատիկից մինչեւ հինգհարյուրապատիկ չափը:

Ակնկալվող արդյունքները, ըստ նախագծի, կլինի բուսական աշխարհին զերծ պահելը հնարավոր ապօրինի հատումների ռիսկերից, որը կզուգորդվի ամանորյա տոնակատարությունների նպատակով եղեւնիների եւ սոճիների օգտագործման նոր մշակույթ՝ ի դեմս համապատասխան տարրայավորմամբ շրջանառությունը:
