Իշխանությունները ծածուկ նոր ծուղակ լարեցին
POLITICSԵրեկ ՀՀ Ազգային ժողովը երկրորդ ընթերցմամբ և ամբողջությամբ ընդունեց ճանապարհային երթևեկության կանոնակարգման բալային համակարգի ներդրման օրինագիծը՝ ընդամենը 57 կողմ, 35 դեմ և 3 ձեռնպահ ձայներով:
Թվում է՝ օրենքը բավական լավն է, գրեթե բոլորը այն գովում էին: Սակայն պարզվում է, որ իշխանությունները, սովորույթի համաձայն, լավ նախաձեռնության ներքո «սղղացրել» են նորամուծություն, որով նոր բեռ են դնում քաղաքացիների վրա, իսկ նպատակը պարզ է. որ վարորդները հնարավորինս քիչ բողոքարկեն տուգանքները:
Հենց այս պատճառով էլ ընդդիմադիր ԲՀԿ և ԼՀԿ խմբակցությունները օրենքների փաթեթին դեմ քվեարկեցին: «Վարորդի ընկեր» ՀԿ-ի նախագահ Տիգրան Քեյանը «Փաստի» հետ զրույցում ասում է.
«Կարծում եմ, որ այստեղ ինչ-որ խաբեության խնդիր կա։ Պետական տուրքի մասին ինչ-որ փոփոխություն է կատարվել դատական հայցեր ներկայացնելու մասով։
Նախկինում քաղաքացիները վարչական մարմնի որոշումների բողոքների մասով պետական տուրքից ազատված էին, որի գումարը կազմում է 4000 դրամ։ Այս օրենքի առաջին ընթերցմամբ քննարկման ժամանակ նման դրույթ նախատեսված չի եղել։
Իսկ երկրորդ ընթերցման ժամանակ, չգիտեմ որտեղից, այդ նախագիծը հայտնվել է և ներառվել հենց այս օրենքի փաթեթի մեջ, որի մասով, ըստ էության, քննարկում չի եղել։
Կարծում եմ, որ ԱԺ-ն չպետք է նման ձև վարվեր, և պետական տուրքի մասով օրենք չպետք է ընդունվեր։ Այստեղ մի շարք խնդիրներ կան։
Նախ՝ մարդու պաշտպանվելու իրավունքից է սահմանափակվում դա, որովհետև քաղաքացին այսօր 1000-2000 դրամանոց վարչական տուգանքների համար չի վճարի 4000 դրամ պետտուրք, որպեսզի վարչական դատարանով բողոքարկի։
Հիմա՝ բողոք ներկայացնելուց առաջ քաղաքացին պետք է 4000 դրամ վճարի՝ անկախ վարչական ակտի գումարի չափից»։
