ՀՀ բարձրագույն դատական խորհուրդ ներկայացված միջնորդությունների վերաբերյալ տարատեսակ մեկնաբանություններից խուսափելու համար տեղեկացնում եմ, որ ՀՀ գլխավոր դատախազի պաշտոնակատար, ՀՀ գլխավոր դատախազի տեղակալ Դավիթ Մելքոնյանի կողմից միջնորդությունները ներկայացվել են ՀՀ հատուկ քննչական ծառայությունում ՀՀ քրեական օրենսգրքի 178-րդ հոդվածի 3-րդ մասի 1-ին կետով, 34-312-րդ հոդվածի 3-րդ մասի 1-ին կետով եւ ՀՀ ԱԱԾ-ում 311-րդ հոդվածի 4-րդ մասի 2-րդ կետով հարուցված, հետագայում մեկ վարույթում միացված քրեական գործերի շրջանակներում, որոնցով նախաքննությունը ներկայումս իրականացվում է ՀՀ ՀՔԾ վարույթում: Այս մասին Facebook-ի իր էջում գրել է Գլխավոր դատախազի խորհրդական Գոռ Աբրահամյանը:

Նա մասնավորապես, նշել է.

«Նախնական քննության ընթացքում ձեռք բերված բավարար ապացույցների համակցությամբ հիմնավորվել է, որ դատական իշխանության մարմնի ղեկավար աշխատակից հանդիսացող Սամվել Ուզունյանը («Հոկտեմբերի 27»-ի գործը քննած դատավոր-խմբ), մի դեպքում 2014 թվականի հոկտեմբերին ներկայացված քաղաքացիական հայցի գործով հայցվորի օգտին դատական ակտ կայացնելու համար միջնորդելու, մեկ այլ դեպքում 2007թ. տեղի ունեցած դեպքի առթիվ հարուցված, ապա վարույթը կարճված քրեական գործով տուժողի օգտին գործողություններ կատարելու՝ ենթադրյալ հանցագործությունը կատարած անձանց քրեական պատասխանատվության ենթարկելուն՝ իր պաշտոնեական դիրքն օգտագործելով նպաստելու համար, նրանցից պահանջել եւ տարբեր ժամանակահատվածներում ստացել է առանձնապես խոշոր չափերով՝ մի դեպքում 13.000 ԱՄՆ դոլարին, մյուս դեպքում՝ 38.000 ԱՄՆ դոլարին համարժեք ՀՀ դրամի կաշառք:

Նախաքննությամբ ձեռք բերված ապացույցների համակցությունը բավարար հիմք է տալիս Ս. Ու.-ին սույն քրեական գործով ներգրավելու որպես մեղադրյալ եւ առաջադրելու մեղադրանք՝ մի դրվագով ՀՀ քրեական օրենսգրքի 38-34-312-րդ հոդվածի 3-րդ մասի 1-ին կետով, մյուս դրվագով ՀՀ քրեական օրենսգրքի 311-րդ հոդվածի 4-րդ մասի 2-րդ եւ 3-րդ կետերով նախատեսված հանցավոր արարքներն առերեւույթ կատարելու համար:

Քրեական գործով ձեռք բերված նյութերը բավարար հիմք են տալիս ենթադրելու, որ ազատության մեջ մնալով, նա կարող է թաքնվել քրեական վարույթն իրականացնող մարմնից, ինչպես նաեւ քրեական դատավարությանը մասնակցող անձանց վրա անօրինական ազդեցություն գործադրելու եղանակով խոչընդոտել մինչդատական վարույթում կամ դատարանում գործի քննությանը:

Հաշվի առնելով այս հանգամանքները՝ ՀՀ գլխավոր դատախազի պաշտոնակատարը ՀՀ Բարձրագույն դատական խորհրդին ներկայացրել է միջնորդություններ՝ տալու համաձայնություն դատական իշխանության մարմնի ղեկավար նախկին աշխատակից հանդիսացած անձի նկատմամբ քրեական հետապնդում հարուցելու եւ նրան ազատությունից զրկելու վերաբերյալ, որոնք բավարարվել են:
