Պատիժը նախատեսվում է խստացնել. ազատազրկում չորսից ութ տարի ժամկետով․ «Փաստ»

«Փաստ» թերթը գրում է․ 

Քննչական կոմիտեն իրավական ակտերի նախագծերի հրապարակման միասնական կայքում հանրային քննարկման է ներկայացրել «ՀՀ քրեական օրենսգրքում լրացում կատարելու մասին» օրենքի նախագիծը։ 

Կոմիտեն առաջարկում է իրավական նոր կարգավորում, որն, ըստ հեղինակների, հնարավորություն կտա համարժեք և համաչափ պատիժ նախատեսել պաշտոնեական լիազորությունները չարաշահելու համար, որը դիտավորությամբ առաջացրել է ծանր հետևանքներ: Նախ՝ գործող օրենսդրության մասին։ 

ՀՀ քրեական օրենսգրքի 308-րդ հոդվածի 1-ին մասի համաձայն՝ պաշտոնատար անձի կողմից իր պաշտոնեական դիրքը ծառայության շահերին հակառակ օգտագործելը կամ ծառայողական պարտականությունները չկատարելը՝ շահադիտական, անձնական այլ շահագրգռվածությունից կամ խմբային շահերից ելնելով, որն էական վնաս է պատճառել անձանց, կազմակերպությունների իրավունքներին ու օրինական շահերին, հասարակության կամ պետության օրինական շահերին՝ պատժվում է տուգանքով՝ նվազագույն աշխատավարձի երկուհարյուրապատիկից երեքհարյուրապատիկի չափով, ինչպես նաև որոշակի պաշտոններ զբաղեցնելու կամ որոշակի գործունեությամբ զբաղվելու իրավունքից զրկելով՝ առավելագույնը հինգ տարի ժամկետով։

 Կամ էլ կարող է կիրառվել կալանք՝ 2-3 ամիս ժամկետով, ինչպես նաև ազատազրկում՝ առավելագույնը չորս տարի ժամկետով: Բացի դա, օրենսդիրը պատասխանատվություն է նախատեսել նաև ծանրացնող հանգամանքներում պաշտոնեական լիազորությունների չարաշահման համար: 

Նույնը 308-րդ հոդվածի 2-րդ մասում որպես ծանրացնող հանգամանք նախատեսված է անզգուշությամբ ծանր հետևանքներ առաջացնելը. «Նույն արարքը, որն անզգուշությամբ առաջացրել է ծանր հետևանքներ, պատժվում է ազատազրկմամբ՝ երկուսից վեց տարի ժամկետով՝ որոշակի պաշտոններ զբաղեցնելու կամ որոշակի գործունեությամբ զբաղվելու իրավունքից զրկելով՝ առավելագույնը երեք տարի ժամկետով»: 

Նշվում է, որ գործնականում հանցագործության որակման խնդիրներ են առաջանում այն դեպքերում, երբ պաշտոնեական լիազորությունները չարաշահելը դիտավորությամբ է առաջացրել ծանր հետևանքներ: 

Իրավակիրառ պրակտիկայում այս դեպքերում, օրենսդրական բացի պատճառով, արարքը որակվում է 308-րդ հոդվածի 1-ին մասով, որն ավելի մեղմ պատիժ է նախատեսում, քան անզգուշությամբ ծանր հետևանքներ առաջանալու պարագայում: 

Այսինքն, գործող օրենքի ներկայիս կարգավորումը հնարավորություն չի տալիս ավելի խիստ պատասխանատվություն սահմանել դիտավորությամբ ծանր հետևանքներ առաջացնելու համար: 

Ըստ քննչական կոմիտեի՝ օրենքի նախագծով առաջարկվող նոր իրավակարգավորումը հնարավորություն կտա համարժեք և համաչափ պատիժ նախատեսել պաշտոնեական լիազորությունները չարաշահելու համար, որը դիտավորությամբ առաջացրել է ծանր հետևանքներ:

 Մասնավորապես առաջարկվում է ՀՀ քրեական օրենսգրքի 308-րդ հոդվածում լրացնել հետևյալ բովանդակությամբ 2.1-ին մաս՝ «սույն հոդվածի առաջին մասով նախատեսված արարքը, որը դիտավորությամբ առաջացրել է ծանր հետևանքներ՝ պատժվում է ազատազրկմամբ՝ չորսից ութ տարի ժամկետով`գույքի բռնագրավումով կամ առանց դրա»: 

Ակնկալվում է, որ օրենքի նախագծի ընդունման արդյունքում կվերացվի օրենսդրական բացը՝ պատիժ սահմանելով պաշտոնեական լիազորությունները չարաշահելու համար, որը դիտավորությամբ առաջացրել է ծանր հետևանքներ՝ դրանով իսկ հստակեցնելով տվյալ հանցագործության որակումը և ապահովելով պատժի համաչափության սկզբունքի պահպանումը:
