Քիչ առաջ հայտարարություն է տարածել ՀՀ երրորդ նախագահ Սերժ Սարգսյանի փաստաբանական թիմը: Հայտարարության մեջ մասնավորաբար ասված է.

«Ի պատասխան բազմաթիվ լրատվամիջոցների՝ ՀՀ երրորդ նախագահ Սերժ Սարգսյանին առաջադրված մեղադրանքի վերաբերյալ պաշտպանական կողմի պարզաբանումները լսելու խնդրանքներին, քրեական գործի նյութերին ծանոթնալուց հետո, այս փուլում, դեռևս ներկայացնում ենք հետևյալը.

  1. ՀՀ երրորդ Նախագահ Սերժ Սարգսյանի պաշտպանական թիմը վերահաստատում է նախաքննության սկզբնական փուլում արտահայտած այն պնդումները, որ Սերժ Սարգսյանին մեղադրանք է առաջադրվել իր պաշտոնեական դիրքի կապակցությամբ գործողություններ կատարելու համար: Մինչդեռ, ՀՀ Սահմանադրության համաձայն՝ հանրապետության նախագահն իր լիազորությունների ժամկետում և դրանից հետո չի կարող հետապնդվել և պատասխանատվության ենթարկվել իր կարգավիճակից բխող գործողությունների համար:
  2. Պաշտպանական թիմը փաստում է, որ ՀՀ երրորդ նախագահ Սերժ Սարգսյանը որպես մեղադրյալ է ներգրավվել ՀՀ քրեական դատավարության օրենսգրքի 202-րդ հոդվածի պահանջների կոպիտ խախտմամբ, քանի որ գործում չկա առերևույթ հանցանքի կատարման մասին վկայող բավարար ապացույցների համակցություն, ավելին՝ գործով հավաքված տվյալները որևէ կերպ չեն փաստում, որ գործը քննվել է ընդհանրապես հանցագործության դեպքի առթիվ: Ավելի պարզ, հավաքված տվյալներն աղաղակում են ընդհանրապես հանցագործության դեպքի բացակայության մասին:
  3. Անդրադառնալով Սերժ Սարգսյանի նկատմամբ ընտրված խափանման միջոցի օրինականության և հիմնավորվածության հարցին՝ պաշտպանական կողմն անառարկելիորեն արձանագրում է, որ գործում բացարձակ չկան այնպիսի փաստական տվյալներ, որոնք թեկուզ և տեսականորեն կարող էին վարույթն իրականացնող մարմնին հուշել պարոն Սարգսյանի կողմից առերևույթ ոչ պատշաճ վարքագիծ դրսևորելու հավանականության մասին, ուստի այս պայմաններում, անձի՝ ՀՀ Սահմանադրությամբ երաշխավորված ազատ տեղաշարժի իրավունքն ապօրինի սահմանափակելը, նույնպես օրինական համարվել չի կարող:
  4. Ինչ վերաբերում է պարոն Սարգսյանի գույքի վրա կալանք դնելու գործողության օրինականությանն ու հիմնավորվածությանը, պաշտպանական կողմը կրկին փաստում է, որ այս դեպքում ևս գործում չկա գեթ մեկ ապացույց, որի հիման վրա քննիչը կարող էր օրենքով սահմանված կարգով արգելադրել անձի գույքը, ուստի այս որոշումը նույնպես չի կարող իրավաչափ համարվել:
  5. Հայտնում ենք նաև, որ վարույթն իրականացնող մարմնի կողմից առանց բավարար հիմնավորումների մերժվել են պաշտպանական կողմի՝ բազմակողմանի օբյեկտիվ և լրիվ քննություն կատարելուն, գործի համար կարևոր նշանակություն ունեցող ապացույցներ ձեռք բերելուն և կոնկրետ դատավարական որոշումներ կայացնելուն ուղղված բազմաթիվ և բոլոր միջնորդությունները, ինչը կրկին վերահաստատում է մեր այն համոզմունքը, որ ՀՀ երրորդ Նախագահ Սերժ Սարգսյանի նկատմամբ քրեադատավարական փաթեթավորմամբ իրականացվում է քաղաքական հետապնդում:
  6. Հաշվի առնելով գործի հասարակական հնչեղությունը, պաշտպանական կողմը պարբերաբար հանրությանը կտրամադրի լրացուցիչ տեղեկատվություն»:
