Ինչո՞ւ է ոստիկանությունն ուզում անպայման ունենալ այդ տեխնիկան. Վարոսյանը՝ գաղտնալսումների օրենքի մասին
SOCIETYԱրդյո՞ք երաշխիք ունենք, որ հաստատապես այն մարմինը, որը կունենա գաղտնալսման հնարավորություն՝ կօգտվի դրանից միայն դատարանի որոշումն ունենալու պարագայում։ Այս մասին NEWS.am-ի հետ զրույցում ասել է փաստաբան Երվանդ Վարոսյանն՝ անդրադառնալով գաղտնալսումների լիազորությամբ ոստիկանության օժտելու մասին նոր օրենքին։
Հիշեցնենք, որ հունվարի 21-ին խորհրդարանը 90 կողմ, 20 դեմ եւ 1 ձեռնպահ ձայների համամասնությամբ ընդունեց ԱԺ «Իմ քայլը» խմբակցության պատգամավորներ Արմեն Խաչատրյանի եւ Սիփան Փաշինյանի հեղինակած «Օպերատիվ-հետախուզական գործունեության մասին» օրենքում փոփոխությունների նախագիծը, որով առաջարկվում է հեռախոսային խոսակցությունները գաղտնալսելու հնարավորություն ընձեռել նաեւ ՀՀ ոստիկանությանը:
«Միայն այն հանգամանքը, որ գաղտնալսող տեխնիկա շահագործելու հնարավորություն տրվում է նաեւ ոստիկանությանը, ինքնին խնդիր չէ, քանի որ նախկինում էլ նույն ոստիկանությունը իրավունք ուներ դատարանից ստանալ գաղտնալսում իրականացնելու թույլտվություն, եւ դա իրականացնել միայն ազգային անվտանգության մարմինների միջոցով։ Առաջին հայացքից կարող է թվալ, թե ինչ տարբերություն կա, եթե նույն դատարանը նույն թույլտվությունը տալիս է։ Եթե ամեն ինչ արվեր օրենքով, մենք էլ երաշխավորված լինեինք, որ անձնական տվյալները հեռախոսային խոսակցությունների գաղտնալսումների ժամանակ օրենքով պաշտպանված են, ապա այդտեղ գուցե խնդիր չտեսնեինք»,- ասել է Վարոսյանը։
Փաստաբանը նշել է, որ, այնուամենայնիվ, ոստիկանությունը հնարավորություն ունենում է գաղտնալսելու. «Խնդիրն այլ է. ինչքանո՞վ ենք մենք երաշխավորված դակող դատավորների առկայությունից։ Արդյո՞ք ունենք երաշխիք, որ հաստատապես այն մարմինը, որը կունենա այդ հնարավորությունը, կօգտվի դրանից միայն դատարանի որոշում ունենալու պայմաններում։ Թե չէ տեխնիկական առումով դա՞ կիրականացնի, թե՞ մեկ ուրիշը. այդքան էական չէ։ Ինձ համար անհասկանալի է այն ձգտումը, որ այդ հնարավորությունն անպայման տրվի նաեւ ոստիկանությանը։ Այսօր էլ ոստիկանությունն այդ հնարավորությունն ունի. դիմում է դատարան, ստանում է թույլտվություն, գաղտնալսելու համար ուղարկում է ԱԱԾ եւ գաղտնալսումն իրականացվում է։ Ինչու է ուզում անպայման ինքն էլ այդ տեխնիկան ունենալ։ Կարծում եմ՝ Հայաստանում գաղտնալսումները միայն դատարանի որոշմամբ չէ, որ իրականացվում են»։
Երվանդ Վարոսյանի համար անհասկանալի է, թե ինչո՞ւ այդ մասին կարծիք չեն հայտնում իրապաշտպանները. «Այս հարցի շուրջ իրավապաշտպանների լռությունն է տարօրինակ։ Ժամանակին մարդիկ կային, որ իրավապաշտպան էին հանդես գալիս, պատկերացնո՞ւմ եք Սերժ Սարգսյանի օրոք նման օրինագիծ լիներ՝ զանգվածային ասֆալատապառկումներ կլինեին»։
