Արդեն տեւական ժամանակ է, որ ՀՔԾ քննիչները եւ ոստիկանության կազմակերպված հանցավորության դեմ պայքարի գլխավոր վարչության աշխատակիցները գտնվում են ՍԴ նախագահ Հրայր Թովմասյանի բնականարնում, սակայն խուզարկությունը դեռ չի սկսվել: Այս մասին այսօր՝ հունվարի 24-ին, լրագրողների հետ զրույցում նշեց ՍԴ նախագահ Հրայր Թովմասյանի պաշտպաններից Ամրամ Մակինյանը:
Նրա խոսքով, պետք է կատարվի խուզարկություն, կա դատարանի որոշում, սակայն խուզարկությունը դեռեւս չի սկսվել, քանի որ քննչական խմբի ղեկավարը խոչնդոտում է իրենց իրավունքների ամբողջ ծավալով իրականացմանը:
Մենք համապատասխան միջնորդություն ենք ներկայացրել, սա աննախադեպ պրակտիկա է Հայաստանի քրեական դատավարության մեջ, որ թույլ չի տրվում անձին, պրոֆեսիոնալ իրավաբանին որոշումը կարդալ: Պատճառաբանություններ, որպես այդպիսին, չեն բերվում: Այնպիսի աննախադեպ իրավիճակ է, որ ես չեմ կարողանում մեկնաբանություններ բերել»,-ասաց նա՝ հավելելով, որ Հրայր Թովմասյանն այս պահին իր բնակարանում է:
Պաշտպանը նշեց, որ պաշտպանական խմբի իրավունքը ամբողջ ծավալով պետք է իրացվի. «Մենք թե գրավոր, թե բանավոր միջնորդել ենք հնարավորություն տալ ծանոթանալ, պատճեն ստանալ այդ որոշումից: Մենք իրավունք ունենք օրենքով սահմանված կարգով, դատարանի որոշումը բողոքարկել: Ո՞նց կարող ենք բողոքարկել մի դատավարական փաստաթուղթ, , որի պատճենը չունենք: 4-5 թերթ որոշումը հիշողությա՞մբ ենք բողոքարկելու, սա ի՞նչ պրակտիկա է:
Պատճառաբանություններ չկան, որպես այդպիսին: Քննիչը պահում է ձեռքին, ընթերցեցին, մենք լսեցինք: Պարոն Պողոսյանին այդպես են ասել. ես ինքս ծանոթացել եմ, բայց մեզ հնարավորություն չի տրվում պատճեն ստանալ:
Իսկ քննչական գործողություններ չեն սկսվում, որովհետեւ պարոն Թովմասյանը դեռ չի ծանոթացել որոշմանը: Քննչական գործողությունն սկսվում է դատարանի որոշմանը ծանոթանալուց հետո: Հիմա կրկին պարոն Թովմասյանի իրավունքները խախտվում են: Հիմա էլ բնակարանի անձեռնմխելիության իրավունքն է խախտվում»,-ասաց պաշտպանը:
Հիշեցնենք, որ ՀՀ ՍԴ նախագահ Հրայր Թովմասյանին մեղադրանք է առաջադրվել 2019 թվականի դեկտեմբերի 27-ին՝ ՀՀ քրեական օրենսգրքի 308-րդ հոդվածի 2-րդ մասի հատկանիշներով՝ պաշտոնեական լիազորությունները չարաշահելու համար։ Նրան որպես մեղադրյալ ներգրավելու որոշումը կայացրել էր ՀՀ գլխավոր դատախազը՝ դեկտեմբերի 26-ին, նույն օրը, երբ ՀՀ նախագահ Արմեն Սարգսյանը ստորագրեց Սահմանադրական դատարանի դատավորներին վաղաժամ թոշակի գնալու հնարավորություն տալու մասին օրենքը։
