SOCIETY«Փաստ» թերթը գրում է․
Երեկ իրավական ակտերի նախագծերի հրապարակման միասնական կայքում արդարադատության նախարարության կողմից տեղադրվել է օրենքի նախագիծ՝ ՀՀ քրեական դատավարության օրենսգրքում լրացումներ կատարելու մասին:
Նախագծով մասնավորաբար առաջարկվում է քրեադատավարական օրենսդրության շրջանակներում հստակ նախատեսել կալանքի կրմանը խոչընդոտող ծանր հիվանդության հիմքով կալանքի կրումից ազատ արձակելու հնարավորություն, ինչպես նաև սահմանել հսկող դատախազի կողմից կալանավորվածներին պահելու վայրի վարչակազմի միջնորդագիրը քննելու և այն բավարարելու կամ մերժելու վերաբերյալ որոշում կայացնելու լիազորություն:
Միևնույն ժամանակ առաջարկվում է ամրագրել հսկող դատախազի կողմից միջնորդագիրն անհապաղ քննելու և այն բավարարելու կամ մերժելու վերաբերյալ որոշում կայացնելու հնարավորություն՝ միաժամանակ նախատեսելով հսկող դատախազի կողմից միջնորդագիրը մերժելու դեպքում այն դատական կարգով բողոքարկելու հնարավորություն:
Նախագիծը նաև սահմանում է ծանր հիվանդության հիմքով անձին կալանքից ազատելու միջնորդագիրը մերժելու մասին հսկող դատախազի որոշման դեմ բերված բողոքը, ինչպես նաև պատժի կրումից ծանր հիվանդության հիմքով անձին ազատ արձակելու վերաբերյալ քրեակատարողական հիմնարկի միջնորդագիրը դատարանի կողմից քննելու սեղմ ժամկետ:
