Տատի իմացությամբ` 9-ամյա տղա երեխան ենթարկվել է սեռական բռնության. Քննչական կոմիտեն մանրամասնում է

Հաշվի առնելով այն հանգամանքը, որ մի շարք զանգվածային լրատվության միջոցներով հրապարակումներ են կատարվել այն մասին, որ 2010թ. ծնված տղայի մայրն ահազանգել է՝ հայտնելով, որ իր որդու նկատմամբ գործադրվել են սեքսուալ բնույթի բռնի գործողություններ, այդ կապակցությամբ տեղեկացնում ենք, որ ՀՀ քաղաքացուհին 2019թ. դեկտեմբերի 30-ին ոստիկանության Քանաքեռ-Զեյթունի բաժնում հաղորդում է տվել այն մասին, որ 2019թ. դեկտեմբերի 26-ին, 27-ին և 28-ին իր անչափահաս՝ 9-ամյա որդու նկատմամբ բնակարանում և նույն շենքի բակում՝ «Մերսեդես» մակնիշի ավտոմեքենայի սրահում, երեք անձինք սեքսուալ բնույթի բռնի գործողություններ են կատարել:
 
Դեպքի առթիվ 2020թ. հունվարի 14-ին ՀՀ ոստիկանության Քանաքեռ-Զեյթունի բաժնում ՀՀ քրեական օրենսգրքի 139-րդ հոդվածի 3-րդ մասի 2-րդ կետով հարուցվել է քրեական գործ, որը 2020թ. հունվարի 15-ին ստացվել է ՀՀ քննչական կոմիտեի Երևան քաղաքի քննչական վարչության Քանաքեռ-Զեյթուն վարչական շրջանի քննչական բաժնում:
 
Նախաքննության ընթացքում երեխան ճանաչվել է տուժող, իսկ երեխայի մայրը՝ տուժողի օրինական ներկայացուցիչ: Երեխան հարցաքննվել է օրինական ներկայացուցչի, փաստաբանի և մանկավարժի ներկայությամբ և տվել ցուցմունքներ: Երեխան հայտնել է, որ իրենց բնակարանում իր նկատմամբ կատարված բռնությանն ականատես է եղել իր տատիկը, որի հետ նույն անձինք ունեցել են սեռական հարաբերություն:
 
Նախաքննության ընթացքում կատարվել են անհետաձգելի քննչական և այլ դատավարական գործողություններ՝ հարցաքննվել են մի շարք անձինք, տուժողի մասնակցությամբ կատարվել է դեպքի վայրի զննություն, որի ընթացքում վերջինս մատնանշել է բնակարանի ննջասենյակը, որտեղ նրա նկատմամբ կատարել են սեքսուալ բնույթի բռնի գործողություններ, ինչպես նաև՝ շենքի բակային տարածքը, որտեղ կայանել է «Մերսեդես» մակնիշի ավտոմեքենան, որի սրահում երեխան ենթարկվել է սեռական բռնության:
 
Տուժող երեխայի մարմնական վնասվածքների ծանրության աստիճանը որոշելու համար նշանակվել է դատաբժշկական փորձաքննություն, որի եզրակացությունն արդեն իսկ ստացվել է:
 
Հանձնարարություններ են տրվել ոստիկանության Քանաքեռ Զեյթունի բաժնին՝ «Մերսեդես» մակնիշի ավտոմեքենան հայտնաբերելու և քննությանը ներկայացնելու ուղղությամբ:
 
Որպես վկա հարցաքննվել է երեխայի տատիկը, ով հերքել է թոռնիկի կողմից հայտնած տեղեկատվությունը:
 
Նախաքննությունը շարունակվում է:
 
Հայտնում ենք նաև, որ նույն երեխայի նկատմամբ սեքսուալ բնույթի բռնի գործողություններ կատարելու դեպքի առթիվ քրեական գործ քննվել է նաև 2017թ., որի ընթացքում տևական ժամանակ կատարվել են քննչական գործողություններ:
 
Նշված քրեական գործը 2019թ. կարճվել է:
 
Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
